DFA says 6 Pinoys from Ukraine arrive in Philippines amid tensions with Russia

Six Filipinos from Ukraine returned to the Philippines on Friday following their request for repatriation from the country, which reports said is on the brink of a Russian invasion. 


According to the Department of Foreign Affairs (DFA), this was possible through the Philippine embassy in Warsaw, which facilitated with the Philippine Honorary Consulate General in Kyiv and the Philippine Consulate General in Istanbul.


"This is to ensure that government assistance is available to the group at all transit points," the DFA said. 


"The Department continues to monitor the situation in Ukraine’s borders while the Philippine Embassy in Poland remains in touch with the Filipino community inside Ukraine," the statement added.


Philippine Ambassador Leah Ruiz urged Filipinos in Ukraine to contact the country's embassy in Warsaw and the Philippine Honorary Consulate General in Kyiv for repatriation requests.

The United Filipino Global-Ukraine group earlier said some Filipinos have fled Kyiv while others availed of the government's free repatriation flights.


US officials had said Russia had amassed more than 130,000 soldiers at Ukraine's borders who could start by bombarding the country's big cities and defense positions with missiles before moving in with tanks.

Grupo dumaing na 'lugi' ang health workers sa One COVID-19 Allowance

May allowances naman na inilaan para sa mga health care workers tulad ng special risk allowance, active duty pay, meals at transportation allowance.


Pero nitong Huwebes, ni-release na ng Department of Budget and Management ang mahigit P7.92 billion na budget para sa One COVID-19 Allowance (OCA) na ipapalit sa mga nauna nang allowance. 



Ayon sa grupong Alliance of Health Workers (ACW), lugi sila dito dahil sa 1.7 million na health care workers, 29 percent lang ang makikinabang dahil hindi lahat ay makakatanggap ng allowance. 


"Maraming dismayadong health care workers. Merong risk classification when in fact ang virus naman matagal nang aerosol siya, airborne siya na dapat pantay-pantay ang pagbigay ng risk allowance na 'yan, wala dapat classification," sabi ni AHW president Robert Mendoza.


Dagdag pa niya, tila tinitipid na naman ng pamahalaan ang mga health care workers.


Pero ayon kay DOH spokesperson Maria Rosario Vergiere, wala naman daw nabawas sa mga matatanggap ng health care workers. Mas pinadali lang umano ang proseso.


"Kapag tiningnan natin, wala tayong tinanggal na allowance, wala rin po tayong binago sa mga allowances, ginawa lang nating mas mabilis ang proseso, not just for the government, but also for the benefit of our health care workers," aniya.

Gordon OKs Linconn Ong's supervised visit to child in hospital

Senators have approved the supervised visit of Pharmally Director Linconn Ong to his child who caught dengue, following an appeal from his wife and for humanitarian reasons, Senator Richard Gordon said on Friday. 


Summer Ong earlier sought the release of her husband from detention at the Pasay City Jail after their child was confined in a hospital. 


But members of the Blue Ribbon Committee, which he chairs, only allowed escorted visits "for a limited time daily" only on the days determined by the panel, Senate Sergeant-at-Arms, and the Pasay City Jail. 


"Each visit shall be jointly supervised by the said authorities... At the same time, I wrote to Mrs. Ong to commiserate with her at this difficult time," he said in a statement. 


"The Blue Ribbon Committee is not without compassion. For humanitarian reasons, but without wavering on or compromising our position regarding his contempt of the Senate, I, as Chairman of the Committee, will allow Mr. Ong fully escorted visits to his son in hospital," he added.


Ong is in quarantine in the Pasay City Jail since December after his supposed evasiveness and failure to submit crucial documents to senators. Last year, Gordon said Ong could be in detention until "June 29 or 30."


Gordon also explained that they did not allow Ong to be released during this time because doing so would "render the Senate powerless to protect itself and the nation."


"If we are to abide by our sworn duty to protect and defend the Filipino people, there can be no room to be soft on crime and to succumb to political pressure," he said. 


This week, the investigative panel also approved the 10-day suspension of the contempt order on Rose Nono-Lin. 


Lin, who is seeking a congressional post, is a stockholder and an officer in several companies linked to Pharmally. 


"We, as senators, should be firm in our resolve to protect and defend not only our duties to investigate, but also against individuals who attempt to make a mockery of our mandated processes," he said. 


President Rodrigo Duterte has expressed his disapproval of the Senate's marathon hearings regarding pandemic deals, lamenting the way lawmakers treat resource speakers, including government officials handling the country's coronavirus response.


The Senate panel is investigating Pharmally after records showed that the budget department's procurement service awarded billions of pesos worth of government contracts to the company that only had less than a million pesos in paid-up capital.


The government denies there was overpricing and said the deals were above board.

"Atin na pong nalampasan ang hamon buhat ng omicron," ani Health Undersecretary Maria Rosario Vergeire. 


Ito ay kasunod ng tuloy-tuloy na pagbaba ng kaso ng COVID-19 sa Pilipinas. 


Mula February 11 hanggang 17, mas mababa na sa 52 porsiyento ang average daily cases ng COVID-19 o nasa halos 2,876 na lang kumpara sa higit 6,034 noong Pebrero 4 hanggang Pebrero 10. 


Lahat ng rehiyon sa bansa maliban sa Cordillera Administrative Region at Davao Region ay low-risk na. 


Ayon sa Malacañang, patuloy na isinasapinal ang road map tungo sa new normal. 


Aminado naman ang Department of Health (DOH) na patuloy pa ring makakaranas ng mga hamon, sa harap ng umiigting na posibilidad ng pag-downgrade ng alert level ng ilang lugar sa bansa. 


"Ma-offset dapat nu'ng hindi puwedeng ipatupad doon sa mga ibang safety protocols na puwedeng ipatupad katulad ng hindi puwedeng mag-physical distance, so dapat mataas ang bakunahan, dapat lahat naka-mask, dapat lahat naghuhugas ng kamay at dapat maayos ang surveillance system para nakakatutok kung sino ang may sakit at dapat iihiwalay sa komunidad," ani DOH Undersecretary Maria Rosario Vergeire. 


Mananatili ang Metro Manila sa Alert Level 2 hanggang katapusan ng buwan.

Malls naghahanda na sakaling ilagay sa Alert Level 1 ang Metro Manila

Naghahanda na ang mga pamunuan ng mga negosyo sa inaasahang paglalagay ng ilang parte ng bansa sa Alert level 1. 


Ang pamunuan ng Ayala Malls, mas daragdagan pa umano ang mga marshal na magpapatupad ng health protocols at mga tauhan na magsasagawa ng disinfection. 


"Pinaghahandaan namin ito. Nakikipag-coordinate kami sa aming mga stores na paigtingin at pahigpitin 'yung mga polisiya… Patuloy ang pagpapatupad ng mga polisiyang ito para hindi na maulit 'yung surge natin," ani Makki Araneta, deputy general manager ng UP Town Center. 


Sa ilalim ng Alert Level 1, mawawala na ang mga restriction sa mga establisimyento at pagbiyahe, maging ang limitasyon sa edad at bilang ng mga tao sa isang lugar. 


Ito anila ang tinatawag na "new normal" na pamumuhay sa gitna ng banta ng virus. 


Magluluwag man, nagpaalala ang Department of Health na dapat sumunod sa minimum public health standards gaya ng pagsusuot ng face mask at pagpapatupad ng physical distancing.

Philippines honors COVID-19 vaccination certificates from more countries

The Philippines has expanded the list of COVID-19 vaccination certificates that travelers must have for entry into the country, Malacañang said on Friday. 


The inter-agency task force on COVID-19, in a meeting on Thursday, accredited certificates from the following territories as proof of vaccination, which travelers can present for entry, quarantine and interzonal or intrazonal movement, said Cabinet Secretary Karlo Nograles.

The government mandated that only fully vaccinated foreign travelers will be allowed entry into the Philippines as part of efforts to address the COVID-19 pandemic.


The Philippines in January fought a record surge in coronavirus infections driven by the highly infectious omicron variant. COVID-19 cases have since fallen below 3,000 a day.

DENR chief Cimatu resigns due to health reasons: Palace

Environment Secretary Roy Cimatu, who oversaw the cleanup of Manila Bay and Boracay island, has resigned from his post, Malacañang said on Friday. 


Cimatu cited health reasons in the resignation letter that he submitted to President Rodrigo Duterte last Monday, according to Executive Secretary Salvador Medialdea. He did not elaborate.


Undersecretary Jim Sampulna was designated as officer-in-charge of the environment department, said Cabinet Secretary Karlo Nograles.


"We wish Secretary Cimatu good health as he transitions from his decades-long and stellar service in government to private life," he said in a statement. 


Cimatu served as chief of staff of the military in 2002 and later as a special envoy for OFW and refugees. He joined President Rodrigo Duterte's Cabinet in 2017. 


Cimatu headed the 6-month rehabilitation of Boracay in 2018 and the cleanup of Manila Bay the next year, which includes a controversial beach made of crushed dolomite.


Cimatu's latest official acts include lifting in December a nationwide ban on open-pit mining, which his predecessor, the late Gina Lopez, imposed in 2017.

Comelec open to revisit rules after 'baklas' backlash

The Commission on Elections (Comelec) on Friday said it is open to revisit its guidelines after several candidates and groups condemned its "Oplan Baklas" targeted against "violative" campaign propaganda. 


In an ambush interview, Comelec spokesman James Jimenez told reporters that the poll body is "not deaf to the clamor of the public."


"In the past we have modified our rules. There's no guarantee na mangyayari yan but certainly we're open... Internally sa Comelec nire-review na rin namin," Jimenez said.


Jimenez added that Comelec commissioners are "looking into the issue already."


The poll body has been under fire for the past few days after they took down allegedly oversized campaign materials in private property.


Last week, the Comelec insisted it has the power to take down oversized campaign materials, even in private properties, citing a 2015 Supreme Court ruling. 


However, several netizens, candidates, and legal groups called out the Comelec after videos of its enforcers dismantling campaign materials even in private spaces went viral on social media. 


Under Comelec Resolution No. 10730 or the implementing rules and regulation (IRR) of the Fair Elections Act, campaign posters should comply with the allowable size of 2ft x 3ft.

Suspected Abu Sayyaf member arrested over P81,000 worth of illegal drugs

The Philippine National Police (PNP) has arrested an alleged member of the Abu Sayyaf Group in a buy-bust operation in Taguig City, a police official said on Friday. 


The suspect, identified as Fahad Dumayag aka Abu Cola, was allegedly carrying 12 grams of suspected shabu worth P81,600, a 40mm M203 grenade, and a rifle grenade when authorities arrested him during the operation, police said.


Southern Police District Police Brig Gen. Jimili Macaraeg, in a statement, said Dumayag, 31, had worked under Abu Sayyaf's units Espilon Hapilon, Jamiri and Undanan. 


The units he was under, Macaraeg said, were allegedly involved in a Jehovah’s Witnesses kidnapping in 2001. 


The police said Dumayag "admitted that he was a member of Abu Sayyaf Group" and a "fanatic." 


"Sa ating patuloy na pakikipag-ugnayan sa iba’t ibang law enforcement agencies ay ating madadakip ang mga terorista na naghahanap ng kanlungan sa ating nasasakupan," said Macaraeg.

Minita Nazario, first female presiding justice of Sandiganbayan, passes away

Retired Supreme Court Associate Justice Minita Chico-Nazario, the first Sandiganbayan Presiding Justice to be promoted to the country's top tribunal, has passed away, the High Court said Friday.


“The Supreme Court and the entire Judiciary join the loved ones of the late Hon. Justice Minita V. Chico-Nazario in mourning her death," the statement read.


"We offer our sincere and deep condolences and prayers. Justice Nazario will always be remembered as one of those who broke barriers in the history of the Philippine Judiciary," it added.


Nazario was the first female Presiding Justice of the Philippines' anti-graft court.


As Sandiganbayan Presiding Justice, Nazario signed a health insurance contract to ensure the hospitalization benefits of the court's employees.


Nazario also signed a similar contract with a health maintenance organization to help with the health needs Supreme Court Justices, officials, and employees when she moved there. 


After her retirement, Nazario also served as the Dean of the College of Law of the University of Perpetual Help System DALTA in Las Piñas City. 


Before working in the judiciary, Nazario was the social secretary of then Justice Secretary Juan Liwag from 1962 to 1963. 


She also worked as a clerk at the City Fiscal’s Office in Manila and as Special Deputy Clerk of Court at a Court of First Instance in Pasay.


A native of San Miguel, Bulacan, Justice Nazario finished law school at the University of the Philippines in 1962.

Palace: Respect Comelec independence on 'Oplan Baklas'

Malacañang said on Friday the Commission on Elections (Comelec) independence should be respected after it drew public ire for the removal of oversized campaign materials in private property, which some argued was unconstitutional. 


The Comelec is “an independent, constitutional body,” said Cabinet Secretary Karlo Nograles. 


“We have to respect the independence of Comelec, especially so dahil election period ngayon (because it's the election period). We respect the independence of Comelec,” he said in a press briefing. 


Those with grievances have “legal recourse that they can also explore,” said Nograles, who is also a lawyer. 


“But as far we are concerned, we must react the independence of Comelec,” he added. 


Presidential contender and Vice President Leni Robredo's camp earlier said the Comelec should respect the right to freedom of speech, which includes putting up posters and on private property. 


The possibility of filing an appropriate case, if needed, is being studied so that the rule on this issue could be clarified, said Robredo's spokesman Barry Gutierrez. 


Another presidential aspirant, Manila Mayor Isko Moreno Domagoso, said the removal of Robredo's campaign materials was "wrong and unfair."


The Comelec has denied that enforcers trespassed the private property to take down posters. 


“As far as entering private areas is concerned, it’s always been part of the practice of Comelec to ask for permission,” Comelec spokesperson James Jimenez told ANC’s “Rundown.”


DUTERTE AND THE COMELEC

 

President Rodrigo Duterte's daughter Davao City Mayor Sara Duterte-Carpio is running for vice president in May's polls in tandem with former senator Ferdinand "Bongbong" Marcos Jr. 


The President has dubbed Marcos Jr. as a "weak" leader. 


Duterte said this month he was "not endorsing" any presidential contender. 


"So far, ganoon pa rin po ang stand ni Pangulo (that is still the stand of the President)," Nograles said.


Duterte has yet to fill up vacancies in the Comelec, following the retirement of chairman Sheriff Abas and commissioners Antonio Kho and Rowena Guanzon. 


"The President is still selecting from the list of candidates. May vetting process po ‘yan," Nograles said, when asked what is delaying Duterte from appointing new Comelec officials.

"But of course, the President knows the importance and urgency also of appointing the very important officials... Soon the President will make the appointment," he said.

DFA chief Locsin calls for early conclusion of Code of Conduct

Foreign Affairs Secretary Teodoro Locsin called for the early conclusion of a Code of Conduct in the South China Sea as he delivered the omnibus Philippine intervention in the ASEAN Foreign Ministers’ Retreat in Phnom Pehn, Cambodia. 


“We want an early conclusion of an effective and substantive Code of Conduct in the South China Sea that excludes no country or power in the rest of the world,” Locsin said.


“The COC will not, nor can it claim for itself the sea after which it is named. That would curtail the immemorial freedom of the seas and international law," he added.


"We appreciate initiatives to finally advance the negotiations beyond the provisional approval of the Preamble," he said. 


Locsin also underscored the importance of the United Nations Convention on the Law of the Sea and the 2016 Arbitral Award in providing “legal clarity” and “just and fair solution to disagreements.”


“Commitment to international law is the only honorable bulwark of law-abiding nations against grim reapers of conflict who thrive in the obscurity of doubletalk. Surrender and submission are out of the question,” he said.


“UNCLOS, whose 40th anniversary we commemorate this year, and the 2016 Arbitral Award, both provide legal clarity to all nations around the globe. These two landmark documents are not just beacons but the only coordinates pointing to a just and fair solution to disagreements.”


Locsin expressed support for granting Comprehensive Strategic Partnership to the United States, saying the US is “the world’s leading force for the rule of law in international relations.”


He also said that looks forward to the convening of the proposed ASEAN-U.S. Summit this year where ASEAN Leaders are expected to meet with US President Joe Biden. 


Locsin, however, rejected a proposal for the Leaders to meet with members of the U.S. Congress, saying it conflates the separation of powers as “foreign policy is the exclusive remit of the executive.”


“We hope the dates can be finalized as soon as possible in view of important religious activities in our region such as the Holy Week and the Holy Month of Ramadan,” he said.


On Myanmar, Locsin said the Philippines will not accept Myanmar’s Instrument of Ratification of RCEP as he called for the implementation of the Five-Point Consensus, including a dialogue that includes Daw Aung San Suu Kyi and President Win Myint.


“It should be a genuine dialogue and not a ventriloquist act,” Locsin said.


The consensus, among others, calls for the immediate stop of violence in Myanmar and calls for a constructive dialogue among all parties concerned to seek a peaceful solution.

No more mandatory quarantine: CAAP releases new rules for returning flight crews

The Civil Aviation Authority of the Philippines (CAAP) on Friday released new guidelines for flight and cabin crew members returning to the country to avoid work disruptions brought by COVID-19 infections.


In a statement, CAAP said the memorandum circulars that they issued on Feb. 7 include not only the flight and crew but also those "with layovers in the country." 


CAAP Director-General Captain Jim Sydiongco said this comes after the directive of Transportation Secretary Arthur Tugade to address the lack of aviation personnel due to mandatory quarantine restrictions.


The new guidelines include the following, according to CAAP.


  • Eradication of mandatory facility-based quarantine for all flight personnel. Self-monitoring for virus symptoms, CAAP said, is important.
  • Suspect COVID-19 positive personnel and those showing COVID-19 symptoms during a layover or in transit should immediately report the developments to the air operator and get monitored. They will be repatriated to their residence.
  • Personnel who were negative for the virus "thorough evaluation in accordance with the said procedures" will also be transported to their residence.
  • Only 1 crew member is allowed per hotel room.
  • Prohibition of contact with other crew members during their stay at the accommodation.
  • Use of hotel common areas is also not allowed. 
  • Air operators must comply with health regulations and COVID-19 protocols. 
  • Transportation must be arranged by the air operator between the aircraft and the crew's hotel rooms (if needed), while ensuring the observance of physical distancing and other health protocols.

Over 200 former UN officers, workers back Robredo's presidential bid

 More than 200 Filipino former officers, workers, and retirees of the United Nations (UN) and its attached agencies have issued a statement of support for Vice President Leni Robredo's presidential bid.


"The emergence of the largest network of volunteers in Philippine electoral history and the birth of the Pink movement that brings diverse sectors and various groups from all over the country prove that the time for change has come," the statement read.


They said among the presidential candidates, it is Robredo who could lead the country for "transformative change."


The signatories, who all worked for UN's headquarters, World Health Organization, UNICEF, and other attached agencies, said their values aligned with Robredo the most.


"Having worked for the UN, we subscribe to the application of international law and thus fully endorse her efforts to move forward with the decision of the Permanent Court of Arbitration (PCA) on the settlement of disputes under the UNCLOS," they added.


"We are also behind her position to welcome the complete resolution of the Philippine case with the International Criminal Court within the context of the country's obligations under the Rome Statute."


The group said Robredo's program of government encompasses the most pressing issues of society, including healthcare, food security, justice, among many other things.


They added that the official's track record also shows she can deliver worthwhile projects despite having a limited budget.


"Her bold action to address the challenges of the COVID19 pandemic in providing adequate healthcare, financial assistance, and livelihood opportunities are evidence of her leadership: compassionate, competent, efficient, effective, and strategic," they added.


Last week, Robredo secured the endorsement of at least 137 economists, including 5 former heads of the National Economic and Development Authority (NEDA) during different administrations. 


So far, Robredo enjoys the support of many sectoral groups but still lags in 2nd place in recent surveys.


In the latest SWS survey, she got 19 percent, next to Ferdinand "Bongbong" Marcos, Jr. who got 50 percent.


In earlier statements, Robredo said she believes the remaining time in campaign is sufficient to flip votes in her favor.


Robredo continues to campaign around the country to woo voters from various regions.

True colors: Comelec explains red, green lights in main building

The spokesman of the Commission on Elections on Friday has explained why its main office in Intramuros, Manila is lit up in red and green colors - the campaign colors of presidential candidate Ferdinand 'Bongbong Marcos and vice-presidential bet Sara Duterte. 


Responding to a Twitter post, Comelec spokesman James Jimenez said the Comelec "is a tenant in that building, which is under the management of Office of the President."


"I have been told that the building’s administration is planning to swap out these ones for differently colored lights," he added. 


Journalist Raissa Robles was among the netizens to ask why the Comelec's Palacio del Gobernador was lit up in known campaign colors of the Marcos-Duterte tandem. 


Last week the Comelec First Division voted to dismiss the 3 consolidated petitions against Marcos, which centered on Marcos' failure to pay income tax and file tax returns while in public office from 1982 to 1985. 


The Court of Appeals acquitted Marcos of non-payment of taxes in 1997, but it upheld the guilty verdict on failing to file tax returns.


The commissioners said that failure to file tax returns is not a crime involving moral turpitude. 


Meanwhile, the Comelec spokesman said he will refer to the Department of Health photos of a "Resbakuna" COVID-19 vaccination event for children that had mascots named "BBM 2022" and "Sara 2022." 


"Partisan politics has no place in official functions," Jimenez said.

PH records 2,232 more COVID-19 cases, 9.1pct positivity rate

The Philippines on Friday recorded 2,232 more COVID-19 cases, continuing its streak of below 3,000 fresh infections for the fifth day, data from the health department showed. 


The positivity rate has declined to 9.1 percent, based on samples of 29,812 individuals on Feb. 16, Wednesday, based on the latest Department of Health bulletin.


Of the newly reported cases, 2,131 or 95 percent occurred within the recent 14 days. Metro Manila (378 cases), Calabarzon (236 cases) and Central Visayas were the top regions with cases in the recent two weeks.


The number of fresh infections is the third-lowest case daily tally so far this year, following 2,196 cases announced Thursday and 2010 cases reported Tuesday, according to the ABS-CBN Investigative and Research Group.


The Philippines has so far tallied a total of 3,648,925 cases, of which 65,796 or 1.8 percent remain active. This is the lowest number of active infections since Jan. 6 when 56,561 active cases were recorded, the ABS-CBN IRG said.


Of those still battling the disease, 60,252 (91.57 percent) were mild cases, 946 (1.44 percent) were asymptomatic, 2,869 (4.36 percent) were moderate cases, 1,422 (2.16 percent) were severe cases, and 307 (0.47 percent) were critical cases.


COVID-related deaths increased by 79, resulting in a total of 55,409 fatalities. This is lowest daily figure since Wednesday, when the DOH announced 77 deaths, the research group said.


Of the newly reported deaths, 16 occurred this month, 32 last month, 1 in November, 11 in October, 12 in September, 5 in August and 2 in July. 


There were 3,010 more recoveries, raising the total number of recuperations to 3,527,720. 


One hundred duplicates, including 95 recoveries, were removed from the total case count, while 70 cases previously tagged as recuperations were reclassified as deaths after final validation, the DOH said.


Five laboratories, which contribute on average 1 percent of samples tested and 0.9 percent of positive cases, were unable to submit their data, the DOH said.


The intensive care unit (ICU) bed utilization rate in Metro Manila and nationwide was at 32 percent and 31 percent, respectively.

The Philippines is now classified as "low risk" for COVID-19 cases due to wide vaccination coverage, the Department of Health said Friday.


The government has fully vaccinated some 62.2 million individuals, while 61.5 million have received an initial dose, and 9.5 million booster shots have been administered as of Thursday.


Some 2,666,272 jabs were administered during the third round of the Bayanihan Bakunahan Program, which ends Friday, according to Health Undersecretary Maria Rosario Vergeire.

All regions in the country except the Cordilleras and Davao region are under a "low risk" case classification and all regions have a negative 2-week growth rate, Vergeire said. The healthcare capacity of all regions except Davao also has a "low risk" classification, she added.


The public is urged to get their booster shots even after contracting COVID-19 as there are no studies on how long natural immunity will last, the spokesperson said.


Individuals aged 18 and above are eligible for booster shots after 3 months of their second dose if their primary series was Sinovac, AstraZeneca, Sinopharm, Pfizer, Moderna, Gamaleya Sputnik V, according to Vergeire. Those inoculated with single-dose Janssen can get their additional dose after 2 months, she said.


"Hindi po tayo (We're not) certain as to when our natural immunity will last. Ang iba po (For some it) will only last 1 month, ang iba (for some) will take months," Vergeire said.

Filipino hailed 'Teacher of the Year' by Florida county

The Duval County in Florida has named Charles Darwin Magdaluyo as the 2022 Vystar Teacher of the Year, besting 180 other nominees from the region.


Born and raised in Manila, Magdaluyo said he considers teaching not just as a profession but as his calling in life.


“When we talk about establishing the trust and confidence of your students, it’s always going back to your purpose why you really want to become a teacher or why you want to do this," Magdaluyo said. "If you like what you are doing, you won’t feel like you are working in the classroom."


Magdaluyo is a graduate of the Philippine Normal University. He came to the US through an exchange teacher program and has been teaching human anatomy and physiology at the Jean Ribault High School in Jacksonville, Florida for over three years.


“Teaching is not just about competence. It’s about commitment and character. When you feel like you have to do something, you have to do it," he added. "My rally is not just to produce students who are strong in mind but also in character.”  


For Magdaluyo, the award is not possible without the dedication and motivation of his parents.


“Education really changed the lives of our family. Ang tatay ko ay jeepney driver, ang nanay ko ay part time tutor," the Filipino teacher shared. "Nakita ko talaga 'yung struggle nila just to raise us. Kaya rin sobrang pursigido kaming mag-aral at makapagtapos sa state universities, dahil alam naming 'yung hirap ng parents naming pagdating sa pag-aaral.”


In his first year of teaching in Florida, Magdaluyo rewarded his dad with a brand new jeepney – a gift that he considered a fruit of his labor.  


“He has been driving for so many years and he is not driving his jeepney before, pero nung nabili ko iyon sobrang tuwang tuwa siya," Magdaluyo said. "Bilang anak, sobrang rewarding 'yun for me, because after all these years they have been working so hard to raise us and right now I am able to give back to my parents.”


Magdaluyo is also providing financial support to his sister who is currently taking up medicine at De La Salle Medical and Health Sciences Institute in Dasmariñas, Cavite.


“Alam naming lahat ng oras, sakripisyo at effort na inilalaan para i-deserve ang ganitong merit," said his sister Charlene. "But more than that we are proud of him because of how many lives he gets to change everyday.”


On the mode of teaching, Magdaluyo said he still prefers face-to-face classes over doing virtual learning, which the school has temporarily applied during the pandemic.


“It makes it more challenging for me to do remediations, to help them out personally because I am very much particular, comfortable doing teaching when I am in front of my students so I can be a guide," he said.


To his surprise, Magdaluyo was awarded a Honda Elantra by the Jenkins Auto Group during the awarding ceremony and some cash certificates. But he says receiving incentives should not be the primary drive for those who want to pursue teaching.


“Go to the teaching profession not because you want to earn more but go to the teaching profession because you want to be of service so you can change the lives of your students," he added.


After receiving the award, Magdaluyo said he is setting his eyes on another prize: the state-wide Teacher of the Year in Florida this 2022.

Comelec denies entering private property without permission to take down oversized campaign posters

The Commission on Elections on Friday denied accusations that they entered private property without permission to take down allegedly unlawful campaign materials. 


The poll body has been under fire for the past few days after they took down allegedly oversized campaign materials in private property.


“As far as entering private areas is concerned Mike, it’s always been part of the practice of Comelec to ask for permission,” Comelec spokesperson James Jimenez told ANC’s “Rundown.”


“Even in the last couple of days, when all of this was really blowing up, what was not being said was that in those cases where they entered into private spaces, the people had asked for permission. Humingi sila ng paalam.”


“We do not go invade spaces, we do not go invade private residences, for the purpose of enforcing our rules. We always ask for permission,” Jimenez added.


“If the property owner says ‘Yeah, I consent to you taking it down but can you do it for me?’ Then yes, we do it for them. But in cases where the property owner says ‘No, I’ll do it myself,’ we leave them alone.”


“If they are not compliant, if they don’t wanna take it down, then we advise them of what our next moves are going to be. Obviously our next moves are going to be citing them in violation of election rules and that would of course lead to all sorts of consequences.”


“Once they get that explanation, some remain adamant and some comply. So that’s all we do,” he said.


Jimenez also addressed the concerns about the presence of policemen during the Comelec’s “Oplan Baklas” operations.


“I certainly did not see any evidence of people being addressed by these armed persons, they were being addressed by Comelec personnel. And armed persons going around sorties of Comelec is pretty standard protective behavior, right?” he said.


“We do have to protect our people going around. That does not mean that these people are being used to coerce private citizens,” he added.


Lawyers have criticized the Comelec’s actions, noting that dismantling campaign materials in private property may be against the law.


In a TeleRadyo interview, Atty. Emil Marañon stressed that the Supreme Court has ruled on the issue of placing election campaign materials on private property.


“Under the law po, yung maximum size ng poster na pwedeng ikabit ng isang kandidato is or political party is only 2 feet by 3 feet po, so that’s very clear. Ang question lang po is kung whether or not nag-aa-apply ba yung size requirement doon sa private citizen na hindi naman nagfo-fall doon sa category na candidate or political party.”


“So this case actually went to the Supreme Court (SC) during the 2013 elections, and it was decided in a case in 2015, in a ponencia written po by Justice (Marvic) Leonen sinasabi niya doon, na hindi po saklaw ng regulatory powers ng Comelec yung private citizens, therefore po ay hindi din po siya sakop ng regulasyon as regards to size.”


“So in other words kahit po lumagpas ng 2 ft. by 3 ft. po yan, hindi po nava-violate nila yung batas regards ng size requirement,” he explained.


The election lawyer added, “Ang sinasabi ng Korte Suprema po, is protected right daw po yan, protected speech--yung paglalagay ng poster supporting endorsing, or opposing a candidate, saklaw ho yan ng ating freedom of expression po.”


Jimenez, however, said that Comelec can regulate poster sizes on private property to ensure a “level playing field” in the election process.


“If you were to pursue certain interpretations of jurisprudence to its logical conclusion, you’d have a situation where a candidate can actually have an entire building covered in their election propaganda, and no one will be able to do anything about it.”


“In such a situation, you’d have an election system that really depends on the number of rich friends you have. And is that really the sort of election system that we have?”


“The need to regulate, even just the size, of propaganda materials inside private properties stems from the need to ensure a level playing field,” he explained. 


But University of the Philippines Constitutional Law Professor Dante Gatmaytan said that freedom of speech of citizens trumps the Comelec’s justifications. 


“The Supreme Court in the diocese case was actually very categorical that size matters. The fact [is] that the Supreme Court said that.”


“Aside from the fact that the Comelec has no authority to regulate speech by non-candidates, the Court also said that regulating the size impairs the speech.”


“In addition to simply not having the authority, regulating tarpaulins and the campaign paraphernalia of non-candidates can also diminish free speech and therefore it was also frowned upon by the court,” he said.


Gatmaytan noted that the Comelec’s move seems to be restricting political speech in the time of an election


“It’s important for us to protect that right, especially in an election…where political views naturally have to be aired,” he said.

Not defamatory, not malicious: ABS-CBN execs defend Cusi Malampaya article

Katigbak, Jumilla urge Taguig prosecutor to dismiss cyber libel complaint


There was nothing defamatory nor malicious in the article that the website of ABS-CBN News published regarding the complaint filed against Energy Secretary Alfonso Cusi before the Office of the Ombudsman, two ABS-CBN executives said Monday. 


“The News Article is not defamatory. The News Article did not make any imputation whatsoever against Sec. Cusi. ABS-CBN News simply reported the filing of the graft complaint against Sec. Cusi, among other respondents, over the sale of Chevron’s stake in the Malampaya project to Dennis Uy’s Udenna Corp.,” ABS-CBN president and chief executive officer Carlo Katigbak and ABS-CBN News Digital executive editor Lynda Jumilla said in their joint counter-affidavit, subscribed to before Taguig City senior assistant city prosecutor Irish-Kay Del Valle.


A copy of the counter-affidavit was later sent by registered mail to Cusi on Thursday.


“ABS-CBN News summarized and quoted the contents of the Graft Complaint, without giving any remark or opinion as to their truthfulness or falsity. ABS-CBN did not make any conclusion or finding as to Sec. Cusi’s guilt or innocence,” they added.


Cusi’s complaint stemmed from an October 19, 2021 article published on ABS-CBN News’ website about the graft complaint filed by three individuals against Cusi, Uy and other respondents before the Office of the Ombudsman in Iloilo. 


Cusi is accused of “gross inexcusable negligence” in supposedly allowing Udenna’s purchase of Chevron’s 45% stake in the Malampaya gas project and in allegedly failing to exercise the government’s right to purchase the shares.


The graft complaint also claimed the DOE under Cusi bent the rules to approve the transaction in favor of Uy’s company, which supposedly led to about P21 to P42 billion in losses a year for the Philippine government. 


Another Uy subsidiary subsequently bought Shell’s 45% share but the Philippine National Oil Company-Exploration Corporation, which owns the remaining 10% share, withheld its consent in December amid the ensuing controversy.


In his complaint against ABS-CBN Corp., Katigbak and Jumilla, Cusi said the story damaged his reputation and good standing in government and asked for P200 million in damages.


In their joint counteraffidavit, Katigbak and Jumilla rejected Cusi’s assertion as “false and baseless.”


Aside from arguing there was no defamatory imputation in the article as it was a straightforward report, the two pointed out, it was not them but the graft complaint that accused Cusi of wrongdoing. 


A defamatory statement is one of the key elements in a libel charge and involves imputing a crime, discreditable act or condition on another person.


That person must however be identified and the allegations published. In the case of cyber libel, the statements should be made through a computer system or similar means.


Another important element is malice. Actual malice means that the libelous remark was made with the knowledge that the statement was false or with reckless disregard as to the truth or falsity of the allegation.


Malice is normally presumed in every defamatory imputation but Katigbak and Jumilla argued, the article was a privileged communication which takes away the presumption and requires Cusi to prove there was actual malice.


The article, according their counteraffidavit, was a fair and true report without any comments or remarks of a judicial and official proceeding. It was based on an actual complaint filed before the Office of the Ombudsman in Iloilo and presented the DOE’s side in the article. 


To show good faith, they cited articles on the issue published by other news entities and several other articles that ABS-CBN News published showing Cusi’s side.


Katigbak and Jumilla also argued Cusi is a public official and the story was about an official undertaking of the DOE — the sale of a substantial portion of the Malampaya project.


No less than the Supreme Court, they said, has recognized that it is in fact a citizen’s “civic duty” to ensure that “public duty is discharged faithfully and well by those on whom such duty is incumbent.”


To prove actual malice, Cusi complained that he should have been asked directly regarding the alleged anomalies in the sale of the shares in the Malampaya project.


But Katigbak and Jumilla pointed out ABS-CBN News asked him personally about his position on the issue through an October 20, 2021 interview on the program Headstart on its subsidiary, the ABS-CBN News Channel/Sarimanok News Network, Inc.


The same interview became the basis of an online article.


“Thus, contrary to Sec. Cusi’s allegations that ABS-CBN News did not get his side of the story, ABS-CBN News in fact gave Sec. Cusi several opportunities to share his response to the Graft Complaint. ABS-CBN News even published an entire news article to allow Sec. Cusi to air his side,” they said.


Katigbak, who is sued as representative of the corporation, also stressed that a company president or CEO like him is not even among the persons responsible for libel under the Revised Penal Code, which only listed the publisher, author or editor of a book, and editor or business manager of a publication as responsible for libel.


He maintained he had no prior knowledge, involvement or participation in the posting of the news article.


Both Katigbak and Jumilla urged the prosecutor to junk the cyber libel complaint due to the absence of probable cause to file it in court.


“[T]he purpose of a preliminary investigation is to ‘shield the innocent from precipitate, spiteful and burdensome prosecution.’ We submit that this Honorable Office should dismiss the Complaint-Affidavit and spare us the hardship and anxiety of a public trial,” they said.


Katigbak and Jumilla emphasized the importance of examining libel cases through the lens of press freedom, particularly when it comes to public officials and the discharge of their functions.


“Men in public life may suffer under a hostile and an unjust accusation; the wound can be assuaged with the balm of a clear conscience. A public officer must not be too thin-skinned with reference to comment upon his official acts. Only thus can the intelligence and dignity of the individual be exalted,” they said, quoting a 1918 Supreme Court case reiterated in so many libel cases.


Cusi’s complaint is separate from the cyber libel case filed by Uy against the same respondents and ABS-CBN reporter Anjo Bagaoisan before the Davao City prosecutor’s office. 


The respondents filed their joint counter affidavit for that complaint earlier this month.


Cusi’s lawyer, incidentally also Uy’s lawyer, initially claimed in an interview on ANC Rundown in December last year that at the time the article in question was published, there was no actual complaint yet filed against Cusi.


But his claim was immediately debunked by Atty. Rico Domingo, a lawyer for the 3 complainants against Uy and Cusi, presented a copy of their complaint stamped received October 18, 2021, by the Office of the Ombudsman, a day before the articles on the complaint came out.


Various groups have denounced Uy’s and Cusi’s libel complaints against different media entities as “harassment” suits meant to intimidate and muzzle the press.

Authorities urged to protect Calbayog City from election violence

The family of slain Calbayog City mayor Ronaldo Aquino on Friday called for more security for the province following a series of killings and urged the public to vote leaders for peace.


The spate of killings continues with a Sanggunian ng Kabataan chairman killed just last week and 3 supporters of a gubernatorial candidate ambushed 2 weeks ago, according to the mayor's son Mark Aquino.


"Kami po ay humihingi ng tulong sa kapulisan at kasundaluhan na sana mabigyang tutok ang aming siyudad, probinsiya," he told ANC's Headstart.


(We are seeking help from the police and military to focus on our city, our province.)


"Siguro ang solusyon dun yung tao mismo ang makakasagot dun, alam nila ano ang puno't dulo nito. Siguro sila ang makakadesisyon lalo na sa darating na halalan kung sino talaga ang may malasakit para sa kapayapaan. Naniniwala ako na hindi po ito magpapatuloy o magpo-prosper kung walang nagfa-finance na malalaking tao."


(The solution can be found among the people, they know what's the root cause of this. They can decide especially in the upcoming elections on who really cares for peace. I believe this will not continue or prosper if there are no big names financing it.)


The mayor's son Julius Aquino will run for vice mayor in the upcoming elections in May, his sibling said. Their father was eyeing to run for the same position before his death.


"Ang brother ko po ay isang doctor, napakagandang propesyon pero tinalikuran niya ito dahil sa kagustuhang magsilbi rin sa mga tao ng Calbayog," he said.


(My brother is a doctor, he turned his back on a good propesyon in his desire to serve the people of Calbayog.)


"Napakahirap at malaking sakripisyo po ang ginawa ng aking brother at pamilya namin kasi galing pa lang kami sa isang trahedya kung saan buhay ng ama namin ang nawala."

The Aquino family welcomes the surrender of 9 policemen involved in an alleged ambush on the mayor, Mark said. Police had initially described the incident as a shootout.


"Unti-unti na pong nabibigyan ng hustisya ang kaniyang kamatayan," he said. "Kami po ay umaasa na magiging patas po ang lahat papunta po sa paghanap ng hustisya sa aming ama po."
