ORDINANCE: APPORTIONING THE SEATS OF THE HOUSE OF REPRESENTATIVES OF THE CONGRESS OF THE PHILIPPINES TO THE DIFFERENT LEGISLATIVE DISTRICTS IN PROVINCES AND CITIES AND THE METROPOLITAN MANILA AREA

 

Section 1. For purposes of the election of Members of the House of Representatives of the First Congress of the Philippines under the Constitution proposed by the 1986 Constitutional Commission and subsequent elections, and until otherwise provided by law, the Members thereof shall be elected from legislative districts apportioned among the provinces, cities, and the Metropolitan Manila Area as follows:


Metropolitan Manila Area

MANILA, six (6) - First District: Barangays Nos. 1-146, N-City Boundary between Manila and Caloocan; E - From Estero de Sunog Apog going South to Estero de Vitas up to the bridge spanning Juan Luna Street, eastward to Tayuman Street up to the Railroad Tracks along Dagupan Street, thence southward to Claro M. Recto Avenue; SE - From point Claro M. Recto Avenue extending westward to Manila Bay; W - Manila Bay northward to City boundary between Manila and Caloocan. Section 2. The Commission on Elections is hereby empowered to make minor adjustments to the reapportionment herein made.


Section 3. Any province that may hereafter be created or any city whose population may hereafter increase to more than two hundred fifty-thousand shall be entitled in the immediately following election to at least one Member or such number of Members as it may be entitled to based on the number of its inhabitants and according to the standards outlined in paragraph (3), Section 5 of Article VI of the Constitution. The number of Members apportioned to the province out of which such new province was created or where the city, whose population has so increased, is geographically located shall be correspondingly adjusted by the Commission on Elections but such adjustment shall not be made within one hundred and twenty days before the election.


Section 4. This Ordinance shall be appended to the Constitution proposed by the 1986 Constitutional Commission, and shall be submitted to a plebiscite simultaneously with such Constitution, and shall take effect upon its ratification by a majority of the votes cast in such plebiscite.

Postscript: Bills such as creating the municipalities in the provinces, and converting the municipality into cities in the previous Congresses were not enacted, now it would be re-filling the measure soon in the 18th Congress, and became laws soon during the mid-term of or before President Rodrigo R. Duterte stepping down in the office on June 30, 2022. Creating the municipalities in the provinces, the provinces from the parent province, and converting the municipality into cities are timely if not overdue.


This means that the _____ would have to be re-filed in the 18th Congress, which convenes on July 22.


The House of Representatives concurred with the Senate amendments, eliminating the need to convene a bicameral conference committee.


Their bills are being prepared for the signature of the Congress leaders before it is transmitted to President Rodrigo R. Duterte for enactment.

March 31, 2021:

"Plus Conversion into a City is the only thing they lack hehe. They are overqualified because of their population.

Taytay and Cainta should definitely be cities, AFAIK Taytay is more densely populated than Antipolo

Many towns should have become cities under the Duterte administration, but only Santo Tomas, Batangas became cities, and then in Calaca, only a signature and a plebiscite were needed to become a city.

  • Cainta, Taytay, Binangonan, San Mateo, and Rodriguez in Rizal
  • Baliuag, Marilao, Santa Maria, and San Miguel in Bulacan
  • Mexico, Porac, and Lubao in Pampanga
  • Capas, and Concepcion in Tarlac Silang, Cavite

The mentioned municipalities are qualified and overqualified to be cities for better opportunities, more income, and more development.

I'm not sure if it's true but one reason why Cainta, Taytay, San Mateo, and Montalban haven't become cities yet is that the Ynares patriarch is against it. It seems that the concern is that the province's income will be reduced if they become a city. It is also related to the case of Antipolo, so the plebiscite has not yet continued to make it a highly urbanized city. Because it would mean not only a loss of income, the people of Antipolo will no longer be able to vote for provincial officials.

Actually, I used to voluntarily tutor kids in their academies (part of my church stuff) and I was surprised at their NB !! (they are studying at the national high school of Antipolo) there is still propaganda behind the NB on what will happen if Antipolo would become an independent component city, which is lopsidedly biased against Antipolo being an ICC.

I've been especially stunned by Ynares since then, who the hell would put such a thing in children's notebooks?

The city of Cabanatuan also in Nueva Ecija still cannot continue the plebiscite because the Umali Patriarchs want the whole province to vote. In San Jose Del Monte, Bulacan last December 2020 proclaimed, that the plebiscite is supposed to be in April but the ARs want it to coincide with the 2022 Elections. If that is how the plebiscite will be held in 2022, then Antipolo and Cabanatuan will also be included in 2022.

And how can the province's income be reduced if the towns become cities? The provincial government still has jurisdiction over the Component Cities until they become Highly Urbanized Cities. "

July 8, 2021:

"Baliwag, Marilao, Pandi, San Miguel, and Santa Maria are QUALIFIED to be CITY.

If Marilao and Santa Maria became cities, they could have their own Congressman because they meet the 250,000 population requirement. The city of Malolos can have its own Legislative District, and the HUC (soon) of SJDM can have two of their districts for Congress.

Cities of Malolos and Meycauayan can also become HUCs.

there is no need to wait for Marilao and Santa Maria to become cities to have a lone district. That can be just filed in Congress like San Mateo and Rodriguez, Rizal.

Oh yes, it can be like that in Cavite back then like Bacoor, Imus, Dasmariñas before they became cities then. So in that case, Marilao is the 7th District and Santa Maria is the 8th District.

Yes, when I was older, Bacoor, Imus, and Dasmarinas became lone districts before they became cities. Although it is possible to pass the bill now because it is an official record, it may not reach for 2022 Elections. Time is too short. If the next representative that covers Marilao and Santa Maria file next year, by 2025 maybe, those two will have a lone district.

If they aim for cityhood, they can also go directly to HUC if that is what will be put in the bill because they are also qualified hehe.

Speaking of that, I'm also not sure if it's possible instead of a component city, a highly urbanized city right away. There is nothing in the Local Government Code about that.

^^ That's okay, that's how I know what was done in San Juan City. Although there is no specific part, the classification of cities in the LGC is identified as well as the qualifications in each classification, so just put that on the bill if you want. So often the long title is "An Act Converting the Municipality of (name) in the Province of (name) into a Component City to be known as the City of (name)". The "Component City" can be replaced by "Highly Urbanized City" or "Independent-Component City" and sections of the bill will also be included.

That's it, practice is always component city first. It is difficult to make HUC immediately because it will be brought to the plebiscite. If the voters are in favor of becoming a city but not in favor of becoming a HUC, chances are, those will be great so the cityhood will be void. "

Pormal nang naghain ng kanyang Certificate Of Candidacy si Dave Almarinez sa Comelec para sa Kanyang kandidatura bilang Lone District Congressman ng San Pedro City Laguna, kasama ang kanyang misis na nagpakita ng full support sa kanyang filing nasi "Ara Mina" na Ngayon ay Mrs. Hazel Reyes-Almarinez, Kasabay din nito si Re-Electionist 1st District Laguna Board Member Abigail Alonte na nag file narin ng kanyang COC sa ilalim ng Nationalista Party (NP) nitong Oktobre 6,2021.

So officially dissolved na ba ang 1st District? Oh informal lang pag gamit nito?

Bale ang Laguna ay may pitong (7) Congressional Districts with the Lone Legislative District of San Pedro as Laguna's 1st Congressional District.

Sa provincial council districts ay 4 districts pa din kung saan ang 1st District ay ang San Pedro, Biñan at Sta. Rosa pa din habang kasama pa din sa 2nd District ng provincial council/board ang Calamba.

Medyo magulo ang set up nyo jan sa Laguna dahil hindi co-terminus ang congressional at provincial council districts mula ng magkaroon ng separate districts ang 4 sa mga cities nyo.

Wala siguro coordination/negotiations with Sangguniang Panlalawigan... basta basta nalang nag file ng pagiging lone District ang tatlong (3) key cities without creating new SP Council Districts kaya nanatiling apat (4) pa rin...

Yes. they should have declared those cities as HUCs (qualified naman sila lahat) or independent cities that are not governed by the provincial government bago gawing Lone Districts. In other regions kasi, Lone Districts are normally HUC's (some even have 2 or more districts) that are independent kaya walang epek sa district numbers ng province where they are geographically located

Dito sa Calabarzon, ibat iba ang set-up eh.

Sa Laguna, yan na nga. Di ko lang alam ang set-up sa Cavite. Parang susmabay naman ata sa pagdami ng districts doon ang pagiging lone districts ng mga cities nila.

Sa Rizal, bagaman 2 ang districts ng Antipolo, di ko alam if kabilang sya sa dami ng districts ng province of Rizal.

Sa Quezon, kahit HUC ang Lucena, di pa sya lone district at part pa sya ng 2nd district and its residents still vote for the congremman of the said district. Kaya same pa rin ang no. of districts ng Quezon.

Ang Batangas province lang ata ang nai-tama, bagamat Lone Districts ang Batangas City at Lipa City, they are still part of the province (kahit qualified nang maging HUCs) kaya officially sila ay 5th and 6th District, kaya naman naging 6 ang distrito sa Batangas.

Ang Cavite, katulad lang din sa Batangas. Bacoor ang 2nd District, Imus ay 3rd District, 4th ang Dasmariñas at 6th ang Gen. Tri, kapwa may mga sariling bokal (2 seats each) din kagaya sa Lipa at BC. Same ang congressional at SP Districts.

Sa Rizal, may bilang din ang Antipolo sa provincial board nila kaso tig-1 seat lang sa 2 districts ng Antipolo or a total of 2 then yung 1st and 2nd districts ay may tig-4 seats. Di ko lang sure kung paano ang allocation ng ng mga bokal ngayon dahil nadagdagan ng distrito ang Rizal Province.

Tayo kasi ang most populated region... pero tingin ko creating a new Congressional district doesn't necessarily mean na magiging ICC o HUC na mga cities natin kailangan lang talaga ng representation sa kongreso para magkaron ng enough funds/allocation for infra projects ng mga cities na ito to ease the lives of their ever growing population.

City LGU's lang naman ang mag-aadopt ng Resolution to request the President for the Conversion into HUC. And speaking of HUC, the Candidates for Mayor ay suporta kaya for the Conversion? Bakit hindi natin i-ask kung suporta sila for the conversion?

IDK, baka nag expire na ang declaration kasi di agad nagka-plebisito? Or is there.such a thing? Yes, ang tagal na rin ng issue ng HUChood ng Cabanatuan. Nabura na rin ata.

Baka sa susunod na Kongreso may maghain na ng conversion into highly urbanuzed city status ng Santa Rosa at Calamba.

Ang alam ko pag HUC, resolution lang from city council na ipapasa sa Presidente ang needed para madeclare na HUC + plebiscite.

Pag ICC, need ng bill to modify the city charter and no plebiscite needed once paased into law dahil hindi sila hihiwalay sa province unlike HUCs na nagpeplebisito dahil ibig sabihin ay aalis sila sa mother province nila.

Tarlac was opposed during the administration of former Governor Margarita Cojuangco yata on that time. Pero ngayon si Governor Susan Yap na, ewan lang kung siya ba ay pabor or tutol for the conversion into HUC ng Tarlac City.

Si Gov Umali naman, ang gusto is whole province ang magparticipate, eh kaso parang lugi ang mga taga-Cabanatuan kung ganyan. I think hindi na ata natuloy iyan kaya need pa din for another resolution of City LGU. Kung si Mayor Cuevas ang mananalo bilang Governor ng Nueva Ecija, well find out kung support niya ang conversion.

The Supreme Court already ruled that plebiscites for conversion into HUC should be participated in by the entire province:

"Additionally, COMELEC is hereby ordered to conduct a plebiscite for the purpose of converting Cabanatuan City into a Highly Urbanized City to be participated in by the qualified registered voters of Nueva Ecija within 120 days from the finality of this Decision. The Petition for Mandamus, docketed as G.R. No. 204371, is hereby DISMISSED."

Pero hindi ata gagamitin ng San Jose del Monte that ruling. But Bulacan LGU can file a petition tama? Pero sa ngayon, wala naman atang problema kay Governor Daniel Fernando.

I think that ruling is already part of jurisprudence and will therefore apply to all future conversions to HUC. I'm not sure, though.

House Bill 64 includes, among others, a specific provision that a plebiscite for conversion to HUC must be conducted in the province, not just the city. This is consistent with the Supreme Court ruling on Cabanatuan's proposed conversion to HUC.
