(1st UPDATE) - Speaker Alan Peter Cayetano said on Wednesday the House of Representatives will start on March 10 its hearings on bills seeking a new franchise for ABS-CBN Corp.
"I'd just like to announce that chairman Chicoy as chairman of the Committee on Legislative Franchises released a notice today that on March 10, 2020 in the Belmonte Hall, South Wing annex, we will be taking up the 11 bills concerning the ABS-CBN Corp. renewal of franchise," he said in a press briefing.
The Lopez-owned network's current license to operate will expire on May 4, 2020. Congress has sessions until March 11 before lawmakers go on a session break until May.
On the first hearing, the House panel will ask parties to submit position papers on ABS-CBN's franchise bid and urge the National Telecommunications Commission (NTC) to grant the network a provisional permit to operate, Cayetano said.
The meeting will also establish ground rules to avoid it from becoming a "circus" or "bull session."
"Ibig sabihin, lahat ng may sama ng loob sa ABS, 'yon ang gagawin. Ayaw din naman natin maging sipsipan forum na lahat ng magsasalita ay isa-isa lang sasabihin kung gaano kagaling, gaano kabango, gaano karami ang nagawa ng ABS. We want to define the issues," he said.
Cayetano reiterated his view that the ABS-CBN franchise renewal bills are not urgent.
"Let me assure ABS-CBN, we know our priorities, you're part of our priorities. Pero 'yong priority na important at urgent ay kailangan unahin," he said, adding the House panel will give the network a "fair and objective" hearing.

Bill creating 2 Maguindanao provinces submitted for House plenary deliberation

COTABATO CITY – The consolidated bill splitting Maguindanao into two provinces has been approved by the House Committee on Local Government, and transmitted for plenary deliberation right after Congress returns from its Lenten break, one of the sponsor-lawmakers announced recently.
In a Facebook post, Maguindanao (2nd District) Rep. Esmael Mangudadatu thanked committee chair, Rep. Noel Villanueva, and members – Reps. Rufus Rodriguez, Prospero Pichay, Johnny Pimentel for their speedy passage and consolidation of two enabling bills in three marathon deliberations last month.
Mangudadatu said he was also elated with the committee’s transmittal of its report on House Bill No. 6413 before the adjournment of the lower chamber’s sessions on March 11, as well as the expressed support of House Speaker Alan Peter Cayetano.
Upon receipt of the committee report last week, the House secretariat was expected to include the bill in the agenda of plenary deliberations when Congress resumes sessions, according to Mangudadatu and Maguindanao (1st District) Rep. Ronnie Sinsuat.
Mangudadatu authored H.B. 3405 for the creation of Southern Maguindanao, while Sinsuat sponsored H.B. 4840 to cause the establishment of Northern Maguindanao.
The committee harmonized the two measures into H.B. 6413, which seeks to split the author’s provincial domain into two provinces to be called Southern Maguindanao and Northern Maguindanao.
Majority of Maguindanao mayors and board members led by incumbent Governor Mariam Sangki-Mangudadatu and Vice Governor Lester Sinsuat attended the committee hearings.
Mangudadatu, a former three-term Maguindanao governor (from 2010 to 2019), said he was confident the plenary approval may be realized within this year.
In the Senate, he said, Senators Christopher Lawrence “Bong” Go and Cynthia Villar were the sponsors of the counterpart bills.
Magundanao, tagged in national statistics as one of the 10 poorest provinces in the country, has a total land area of 9,729.04 square kilometers with a population of 1,173,933 as of 2015 census, according to Wikipedia. It comprises 36 municipalities, with Buluan as its present capital town.
“Logically, the smaller the area to manage, the more focused and faster growth to happen,” Mangudadatu said.
The proposed Western Maguindanao will comprise 11 towns, namely Datu Odin Sinsuat, Datu Blah Sinsuat, Sultan Kudarat, Sultan Mastura, Upi, Kabuntalan Mother, Northern Kabuntalan, Parang, Buldon, Matanog and Barira. Datu Odin Sinsuat is proposed as its capital town.
Maguindanao, on the other hand, is proposed to cover 25 smaller towns, namely Pagalunga, Buluan, Sultan sa Barongis, Shariff Aguak, Talayan, South Upi, Datu Piang, Datu Paglas, Ampatuan, Libutan, General Salipada K. Pendatun, Mamasapano, Sultan Sumagka, Datu Montawal, Paglat, Guindulungan, Datu Saudi-Ampatuan, Datu Unsay, Datu Abdullah Sangki, Rajah Buayan, Pandag, Mangudadatu, Datu Anggal Midtimbang, Datu Hoffer Ampatuan, Datu Salibo and Shariff Saydona Mustapha.
In the proposed law it stated "Any municipality that may hereafter be created within the jurisdiction of their provinces shall automatically form part of its constituent units."

'I am just one vote': Paolo Duterte says ABS-CBN franchise renewal up to House peers
Deputy House Speaker Paolo Duterte said Tuesday ABS-CBN Corp. "should not worry" about his stance on its franchise renewal because this would be up for all members of Congress' lower chamber to decide.
President Rodrigo Duterte's eldest son made the statement after Philippine Star, quoting 2 House insiders, reported that the lawmaker "silently opposed" bills seeking the renewal of ABS-CBN franchise, set to expire on May 4.
"Right now, I am leaving it to the [House franchise] committee and ultimately, to all the members of the House of Representatives to decide on this matter," said Paolo.
"At the end of the day, I am just one vote. Let’s wait for that day. ABS-CBN should not worry about my position on this, because I will do my job to the best of my ability," he added.
The country's largest media and entertainment network "should learn to be patient," said the Congress representative of Davao City's first district.
Paolo's sister Davao City Mayor Sara Duterte-Carpio expressed her support for a new license to operate for ABS-CBN after their father accepted its apology over the airing of critical campaign commercial in 2016.

Media networks say high ratings maintained in Feb.
CITING different rating providers, ABS-CBN Corp. and GMA Network, Inc. reported on Tuesday that they had kept their ratings high last month.
The Lopez-led media giant said its nationwide TV audience share for the month of February, as reported by Kantar Media, stood at 39%, beating its rival GMA’s 33%.
ABS-CBN said Kantar Media used a nationwide panel composed of 2,610 urban and rural homes, representing 100% of the total TV viewing population of the country.
GMA said it recorded an average of 35.2% total day people audience share nationwide last month against ABS-CBN’s 32.1%. The network cited data from Nielsen TV Audience Measurement.
“The Kapuso Network’s overall lead was mainly driven by its steadily improving numbers in the morning and afternoon blocks,” it said.
For its part, ABS-CBN said: “The network kept its stronghold of primetime, earning 43% versus GMA’s 33%.”
GMA said it ruled in Urban Luzon with 37.2% average total day people audience share, beating ABS-CBN’s 29.5%. It added that it was also winner in Mega Manila with 38.1% while ABS-CBN only got 27.5%.
In the list of top-rating programs, Kapuso Mo, Jessica Soho (KMJS) is still the consistent number one show nationwide.
More GMA shows also occupied the overall top 30 lists in the respective areas — 17 in both NUTAM and Urban Luzon; 19 in Mega Manila; and 16 in Urban Visayas.
Joining KMJS as the Network’s top-rating shows for February were 24 Oras, Wowowin Primetime, Daig Kayo ng Lola Ko, Magpakailanman, Descendants of the Sun The Philippine Adaptation, Centerstage, Anak ni Waray vs Anak ni Biday, The Gift, Daddy’s Gurl, Pepito Manaloto, Amazing Earth, The Boobay and Tekla Show, Prima Donnas, Madrasta, Bilangin ang Bituin sa Langit, Love of my Life, Bubble Gang, Saksi, Unang Hirit, Mars Pa More, Eat Bulaga, Tadhana, Ilaban Natin Yan, Imbestigador and Magkaagaw.

The most watched programs in February were produced by ABS-CBN, with primetime stalwart FPJ’s Ang Probinsyano remaining at the top spot with 34%. Julia Montes’ comeback, meanwhile, was an instant hit as the weekly action-drama 24/7 recorded 27%.
TV Patrol (26.5%) remained as the most preferred newscast in the country, while viewers tuned in to the intense battle of contestants and coaches in The Voice Teens (26.4%), which returned for a new season in February.
The love story of Billy (Liza Soberano) and Gabo (Enrique Gil) in Make It With You (25.9%) consistently brought kilig all throughout the love month. MMK (24.9%), on the other hand, touched viewers’ hearts with its real-life stories, while the talented contestants of Your Moment (23.9%) impressed viewers nationwide.

ABS-CBN, GMA both claim lead in February ratings war
COMPETITORS ABS-CBN Corp. and GMA Network Inc. claimed separately on Tuesday that they won the national ratings war last month.
Citing data from Kantar Media, the Lopez-led multimedia conglomerate said it continued to be the No. 1 network in the country in February, after recording an average national audience share of 39 percent, or six points higher than GMA’s 33-percent share.
It also claimed leadership in the prime-time block with 43 percent of households tuning in to the network. GMA was 10 points below at 33-percent share. The prime-time block is the most important part of the day when most Filipinos watch TV and advertisers put a larger chunk of their investment in to reach more consumers effectively.
In a separate statement, GMA, citing data from Nielsen, said it led in the National Urban Television Audience Measurement (Nutam) with 35.2 percent average total day people audience share, a few percentage points higher than ABS-CBN’s 32.1-percent share.
GMA also won in the morning block with a 29.4-percent share versus the competitor’s 26.3-percent share; and the afternoon block, after clocking in 38.4 percent in audience share, while its rival got 30.9 percent.
Likewise, the Gozon-led broadcaster said it recorded a 37.2-percent total day people share in Urban Luzon, a 7.7-point lead versus its competitor, while also winning in Mega Manila with 38.1 percent as compared to the Lopez-led company’s 27.5-percent share.
Urban Luzon accounts for 72 percent of all urban TV viewers in the country, while Mega Manila represents 60 percent of all urban households in the Philippines.
Lastly, GMA said it beat ABS-CBN in Urban Visayas, after netting 35.7 percent of the area’s viewers, while ABS-CBN managed to keep at least 34.1-percent hooked in its programs.
GMA bases its claims to leadership from Nielsen data, which has a nationwide sample size of 3,500 urban and rural homes.

Kris Aquino pays tribute to former ABS-CBN co-workers amid franchise challenge
Former ABS-CBN host and actress Kris Aquino paid tribute to her co-workers during her nearly two-decade stay with the network, amid challenges to its broadcast franchise renewal.
On her social media pages, Aquino shared clips from her various programs with the Kapamilya network, from ‘90s talk show “Today with Kris Aquino” to the lifestyle reality series “Kris TV”.
Aquino, who parted ways with ABS-CBN in 2016, wrote on Monday: “Unfortunately, we don’t get to choose how a relationship ends, but I have learned, we do have a say in what memories we choose to keep.”
Aquino’s message came amid uncertainties surrounding the franchise renewal of ABS-CBN, putting at risk some 11,000 jobs across the network’s companies.
“I am only expressing sincere, heartfelt thanks for what shall forever be an unforgettable period, where my personal and professional lives seamlessly intersected,” Aquino said.
“Both my sons went from crawling to running while celebrating our many milestones on ABS-CBN,” she added, referring to Josh, now 24, and Bimby, now 12.
Through her talk shows on ABS-CBN, Aquino’s personal life also unfolded before the public eye, from her failed romances, to her children’s achievements.
After leaving ABS-CBN, Aquino launched her own digital series, where she similarly gives followers a look into her personal life.

Five more senators move to extend ABS-CBN franchise

FIVE more senators moved to extend the validity of the ABS-CBN franchise until 2022, while its renewal remains pending in the 18th Congress.
Senators Juan Miguel F. Zubiri, Sherwin T. Gatchalian, Emmanuel Joel J. Villanueva, Maria Lourdes Nancy S. Binay and Juan Edgardo M. Angara will be filing a concurrent resolution allowing the network to operate until the final determination of its franchise.
Before this, Senator Franklin M. Drilon filed Concurrent Resolution No. 6, which carried the same proposal; while Senator Ramon B. Revilla, Jr. filed Senate Bill No. 1374 to extend the franchise until 2020.
“The removal of a market leader such as ABS-CBN would have a significant impact, not only on competition within the broadcasting industry, but also on the economy as a whole,” the draft concurrent resolution, shared among reporters, read in part.
The Senators are concerned about the 11,000 direct employees at risk of being displaced if the media network halts its operations, when its franchise expires on May 4.
In previous cases, Congress did not need to pass a concurrent resolution to allow the extended operation of franchise holders, whose franchise already lapsed.
Case in point is the Catholic Bishops’ Conference of the Philippines, which operated until 2019, despite its franchise’s expiration in 2017.
The National Telecommunications Commission (NTC), upon the advise of the Department of Justice, asked Congress to pass the concurrent resolution mandating it to provide a provisional authority to ABS-CBN.
The NTC argued it was necessary considering the objection the network was facing, which include a quo warranto petition filed by the Office of the Solicitor General.
Senate President Vicente C. Sotto III, for his part, maintained the chamber should discuss first the concurrent resolution. He previously said it was not necessary, considering it was not required in the cases of CBCP, Smart Communications, Inc. and Globe Telecom, Inc.

He also said that the delay resulted from other concerns that hit the country since January, such as the Taal volcanic eruption and the coronavirus disease 2019 outbreak.
“That’s why I keep saying napaka-importante ng franchise ng ABS, pero hindi ito urgent, because hindi naman mag-o-off the air ang ABS-CBN. So, konting understanding ang hinihingi namin,” he said.

FIVE more senators moved to extend the validity of the ABS-CBN franchise until 2022, while its renewal remains pending in the 18th Congress.
Senators Juan Miguel F. Zubiri, Sherwin T. Gatchalian, Emmanuel Joel J. Villanueva, Maria Lourdes Nancy S. Binay and Juan Edgardo M. Angara will be filing a concurrent resolution allowing the network to operate until the final determination of its franchise.
Before this, Senator Franklin M. Drilon filed Concurrent Resolution No. 6, which carried the same proposal; while Senator Ramon B. Revilla, Jr. filed Senate Bill No. 1374 to extend the franchise until 2020.
“The removal of a market leader such as ABS-CBN would have a significant impact, not only on competition within the broadcasting industry, but also on the economy as a whole,” the draft concurrent resolution, shared among reporters, read in part.
The Senators are concerned about the 11,000 direct employees at risk of being displaced if the media network halts its operations, when its franchise expires on May 4.
In previous cases, Congress did not need to pass a concurrent resolution to allow the extended operation of franchise holders, whose franchise already lapsed.
Case in point is the Catholic Bishops’ Conference of the Philippines, which operated until 2019, despite its franchise’s expiration in 2017.
The National Telecommunications Commission (NTC), upon the advise of the Department of Justice, asked Congress to pass the concurrent resolution mandating it to provide a provisional authority to ABS-CBN.
The NTC argued it was necessary considering the objection the network was facing, which include a quo warranto petition filed by the Office of the Solicitor General.
Senate President Vicente C. Sotto III, for his part, maintained the chamber should discuss first the concurrent resolution. He previously said it was not necessary, considering it was not required in the cases of CBCP, Smart Communications, Inc. and Globe Telecom, Inc.

The House of Representatives approved on second reading 3 franchise bills as it continued not to act on the franchise application of ABS-CBN Corporation, with 5 session days to go before it goes on a nearly 2-month break.
Approved in separate viva voce votes were the franchise renewals of FBS Radio Network Inc., Century Communications Marketing Center Inc., and Bayan Telecommunications Inc.

Cayetano denies franchise delay to put ABS-CBN on politicians' leash
House Speaker Alan Peter Cayetano denied Monday that a delay in his chamber's action over bills seeking the franchise renewal of ABS-CBN Corp. was meant to put the country's largest media and entertainment company under the control of politicians.
ABS-CBN's franchise expires on May 4. Cayetano earlier said the House might tackle the franchise bills that month or after President Rodrigo Duterte's State of the Nation Address in July.
"‘Yung sinasabi namang iimpluwensiyahan sila, bakit? Wala namang eleksyon e... Ibang usapan kung sasabihin naming sa inyo, hanggang eve ng eleksyon, walang franchise ang ABS-CBN," Cayetano told reporters.
(Why will people say that ABS-CBN will be influenced? There is no election. It will be a different issue if until the eve of the elections, ABS-CBN has no franchise.)
With 65 years in service, ABS-CBN "know how to resist politicians," added the lawmaker.
"I will do all I can ma-prevent that anyone will take advantage of the situation and try to dictate or influence ‘yung news ng ABS-CBN," he said.

The franchise renewal of media outlets GMA-7 and 5 did not encounter any problem because they did not face any complaint of election meddling, said Cayetano.
"Sa ABS-CBN, it’s a perennial complaint," he said.
ABS-CBN "does not and will not have its own political agenda," its president and CEO Carlo Katigbak last week told a Senate hearing into the network's franchise compliance.
Katigbak in the same hearing apologized “if we offended the President” over a 2016 election ad that showed video of Duterte cursing and making inappropriate gestures with clips of children asking if his actions were right.
The network was “just abiding by the laws and regulations that surround the airing of political ads,” he said.

9 senators seek extension of ABS-CBN operations pending franchise renewal
Nine senators on Monday filed a concurrent resolution seeking to allow ABS-CBN to operate as the 18th Congress tackles bills on the renewal of its franchise, which is set to expire in May this year.
Senate Majority Leader Juan Miguel Zubiri, Senate President Pro Tempore Ralph Recto, and Senators Lito Lapid, Sherwin Gatchalian, Joel Villanueva, Nancy Binay, Sonny Angara, Grace Poe, and Manny Pacquiao filed Senate Concurrent Resolution No. 7 “to express the sense of the Congress that ABS-CBN Corporation should be allowed to operate under the terms of its existing franchise pending final determination of the renewal of its franchise by the 18th Congress and for the National Telecommunications Commission (NTC) to issue ABS-CBN Corporation the appropriate provisional authority.”
There are currently several bills in both chambers of Congress seeking to extend the media giant’s franchise for another 25 years.
In filing the resolution, the senators pointed out that the “non-renewal of ABS-CBN’s franchise will result in the loss of thousands of jobs as the network has over 11,000 employees including its artists, independent contractors, content creators who are spread out in ABS-CBN’s information and entertainment group of companies.”
The senators said that the “the removal of a market leader such as ABS-CBN” would significantly impact “not only on competition within the broadcasting industry, but also “on the economy as a whole.”
“In fact, Socioeconomic Planning Secretary Ernesto Pernia was quoted as saying that the non-renewal of the franchise of ABS-CBN may affect investor confidence and get in the way of promoting diversity in the economy and fostering competition,” the resolution read.
The senators said there “is an urgent need to devise government interventions to ensure that ABS-CBN will continue its operations pending Congress’ deliberations of the network’s franchise renewal.”
The resolution noted that there had been instances where franchise holders like GMA Network, Catholic Bishops’ Conference of the Philippines (CBCP), TV5 Network, Inc., among others, had been allowed to operate under the terms of their existing franchise even after its lapse and pending its renewal.
“In the case of CBCP, it was allowed to operate for a period of almost two years from the lapse of its franchise in 2017 until its renewal in 2019,” the senators noted.
The five senators filed the said resolution following last week’s Senate public services committee hearing on the franchise of ABS-CBN where Justice Secretary Menardo Guevarra said Congress—through a concurrent resolution—could direct the NTC to grant provisional authority to ABS-CBN to continue its operations pending deliberation on bills on the network’s franchise renewal.
“Secretary Guevarra noted that Congress may not be able to act on pending bills before expiration of the franchise on May 4, 2020, given that Congress only has two weeks remaining before adjournment of session,” the resolution further read.
Senate Minority Leader Franklin Drilon has already filed a joint resolution and a separate concurrent resolution seeking the extension of ABS-CBN’s operations as bills on the renewal of its franchise remain pending in the 18th Congress.
Congress will go on break on March 12 and will resume session on May 4.

Muntinlupa’s road to cityhood
YESTERDAY (March 1, 2020) Muntinlupa marked its 25th anniversary as a highly urbanised city.
When I assumed office as OIC Mayor in June 1986, Muntinlupa was still classified as a fifth class municipality. It was earning approximately P28 million per year which was hardly sufficient to pay for the salaries of municipal employees.
Thus, during my first two years (as OIC), I focused on growing Muntinlupa’s income, employing best practices to improve tax collection. We were among the very first local government units (LGUs) to computerize, to adopt the One Stop Shop system for paying taxes, and the Real Property Tax Administration system (RPTA) recommended by the Department of Finance (DOF).
Thereafter, for years in a row, the DOF rated Muntinlupa as Best in Realty Tax Collection Efficiency.
Muntinlupa’s income grew rapidly so that by the time we applied for cityhood in 1994 our yearly income based on 1991 constant prices was P88 million plus – way above the minimum requirement. At that time, the minimum income qualification to convert to a city was only P50 million for two consecutive years. The threshold was raised later to P100 million.
With our qualification, we were able to aim for the status of a first-class highly urbanized city (HUC). As HUC, Muntinlupa would be entitled to more autonomy (compared to a component city (CC)). A component city remains part of a larger government unit, like a province. On the other hand, Muntinlupa would have its own city charter, (thus independent of any province) and would also be entitled to its own legislative district.
Becoming a city has its advantages, in terms of added prestige, greater autonomy, better representation in Congress and, regardless of classification whether HUC or CC, a bigger share of the Internal Revenue Allotment (IRA). If memory serves, just by converting into a city, Muntinlupa’s share of the IRA immediately increased by P100 million yearly.
The process of applying for cityhood started with the passage of a resolution passed by the municipal council, accompanied by the municipal treasurer’s certification to Congress that Muntinlupa possessed the minimum qualification, as to income. A certification from the Statistics Office, regarding population (at least 150,000), was also needed. The resolution was immediately provided by the municipal council which was then headed by Vice Mayor Jimmy Fresnedi. The local political opposition, however, strongly opposed cityhood in the mistaken belief that cityhood would allow me to run as city mayor after 1998, when my third term as municipal mayor would have ended.
The proposed cityhood of Muntinlupa was actively supported in the House of Representatives by Congressman Ciriaco Alfelor (Camarines Sur), chair of the Local Government Committee, and Elias Lopez (Davao City) and Ceferino Padua (Agusan del Sur), members. Sen. Raul Roco sponsored the counterpart bill in the Senate.
To give credit where credit is due, Majority Floor Leader Raul Corro, then the municipal attorney, quarterbacked the whole process from start to finish – from the solicitation of legislative sponsors to preparing the groundwork for the public hearings that were held in Muntinlupa. He also participated actively in the public information campaign leading to the plebiscite which approved cityhood. If I am the Father of the Cityhood of Muntinlupa, Atty. Raul Corro is its architect.
The approval of the House version of the cityhood bill went without any hitch. But the final proceeding at the Senate was intense with drama and suspense. The cityhood bill was calendared for third and final reading on the very last day of the session of the Senate before Congress adjourned. It was now or never.
I, then Vice Mayor Jimmy Fresnedi, majority of the council, and the department head attended in full regalia, expecting easy sailing for our cityhood. We could not have been more wrong.
What we all thought would be a walk in the park turned into a tortuous wait. Earlier in the day, around 9 a.m., a senator told me: “Your cityhood is as good as dead!” I dismissed the remark. I thought he was just kidding. After all, he was my Aquila Legis fraternity brod at the Ateneo law school. The remark, however, started to assume the proportion of an actual threat when we were made to wait for hours and hours.
At 15 minutes to midnight (!), my brod approached me. He said: “Brod, you can still save your cityhood. That is, if you will agree that Muntinlupa’s representation in Congress will be effective in 1998 and not in 1995, as originally provided in the bill.”
I had to make a quick decision. After consulting with Vice Mayor Fresnedi and the councilors present, I agreed to the proposal. At two minutes before midnight, a motion to approve Muntinlupa’s cityhood was made and, thereafter, unanimously approved.
President Fidel V. Ramos, Muntinlupa’s favorite resident, signed the Muntinlupa Cityhood Law on March 1, 1995. He was not aware, however, of the drama that happened on the Senate floor.

Protest to continue ‘til ABS-CBN franchise renewed
WITH ABS-CBN's broadcasting operation still uncertain following its franchise renewal remain pending in Congress, the National Union of Journalists of the Philippines (NUJP) will continue its Black Friday protest nationwide until the government acts on it.
NUJP-Davao Chapter spearheaded its first Black Friday protest in front of the ABS-CBN Broadcasting Complex in Shrine Hills, Matina on February 28.
The journalist union recently announced that all ABS-CBN stations in Mindanao namely, General Santos City, Davao City, Cagayan de Oro City, Zamboanga del Sur, and Tandag City in Surigao del Sur, will take part in the solidarity process, which calls for the government to act on the network’s franchise renewal immediately.
NUJP national directorate Kath Cortez, during the protest rites, said they are continuously calling for the government, particularly the House of Representatives, the Senate, and other concerned government agencies, to grant the network another 25-year franchise operation for the sake of the 11,000 employees nationwide, both regular and contractual.
Cortez said the delaying tactics in ABS-CBN's franchise renewal is an attack against press freedom, not only in the media community, but for the entire Filipino.

As of now, Cortez said they are planning to do the Black Friday protest weekly until there would be positive development with ABS-CBN's franchise application.
NUJP initiated in January 2020 the protest in front of ABS-CBN's national headquarters in Sgt. Esguerra Avenue in Diliman, Quezon City as a solidarity to the network.
Meanwhile, employees of ABS-CBN Davao also had its own activity.
In some online posts, the local network employees conducted their own candlelight vigil inside the compound, wearing a white t-shirt with a #foreverkapamilya and a red, blue, and green ribbon print design symbolizing the networks color trademark.
An ABS-CBN Davao employee, who opted not to be named due to the temporary restraining order issued by the Supreme Court, said the management is thankful for the support of the NUJP and some of their viewers who voiced out their support.
ABS-CBN chief executive officer Carlo Katigbak apologized recently to President Duterte for the network’s failure to air his P7 million worth of campaign. Duterte was a former Davao City mayor who won the presidency in 2016.
Katigbak also apologized for airing a political advertisement paid for by the camp of former senator Antonio Trillanes IV, one of the President’s most vocal critics, showing children questioning Duterte who issued a death threat and cursed the pope, among others.
Duterte already accepted the network official's apology, but he said he could not do anything to stop the quo warranto petition filed by the OSG against the television network.
The petition, which seeks to revoke the legislative franchise of ABS-CBN, is scheduled to be heard by the Supreme Court en banc on March 10, 2020.
Recently, Presidential daughter and Davao City Mayor Sara Duterte-Carpio voiced out her support to the network's franchise renewal.
Duterte-Carpio said her constituents in Davao City are in favor of ABS-CBN's renewal.
The President’s daughter said she is hopeful that issues surrounding the franchise renewal of the Kapamilya network will be resolved “in a very positive way.”

NUJP-Davao Chapter spearheaded its first Black Friday protest in front of the ABS-CBN Broadcasting Complex in Shrine Hills, Matina on February 28.
The journalist union recently announced that all ABS-CBN stations in Mindanao namely, General Santos City, Davao City, Cagayan de Oro City, Zamboanga del Sur, and Tandag City in Surigao del Sur, will take part in the solidarity process, which calls for the government to act on the network’s franchise renewal immediately.
NUJP national directorate Kath Cortez, during the protest rites, said they are continuously calling for the government, particularly the House of Representatives, the Senate, and other concerned government agencies, to grant the network another 25-year franchise operation for the sake of the 11,000 employees nationwide, both regular and contractual.
Cortez said the delaying tactics in ABS-CBN's franchise renewal is an attack against press freedom, not only in the media community, but for the entire Filipino.

Fans of Kapamilya stars gathered outside the ABS-CBN Compound in Quezon City Sunday to show their support for the franchise renewal bid of ABS-CBN Corp., the country's largest broadcast network.
Clad in red, blue and green shirts, fans of Kapamilya stars and love teams held placards saying "No To ABS-CBN Shutdown," "Kapamilya Kami," and "Family Forever," as well as placards of support for their favorite stars.

Sotto: No rush in ABS-CBN franchise grant
Senate President Vicente Sotto III assured on Saturday that the Upper Chamber will not rush the grant of an extended franchise to ABS-CBN or any other organizations.
In a statement, the Senate leader maintained that they will stick to legislative procedures under the Constitution with regards to giving franchises to public utilities.
He said senators “would not be stampeded into resorting to short-cuts in the performance of their duties.”
“We follow specific procedures in granting franchises. We cannot do away with certain steps to fast-track the process, or else we can be unjustly accused of currying favors to specific parties,” Sotto said.
“We will maintain an unbiased treatment to organizations asking for renewal of their franchise,” he added.
Sotto issued the statement amid claims that the Senate is giving preferential treatment to ABS-CBN amid moves from the government to stop its operations.
The Senate public services committee, led by Senator Grace Poe, last Monday held a hearing into the alleged violations committed by the broadcast network.
In a recent interview, Poe dismissed claims that she was biased towards ABS-CBN whose talents include her mother, veteran actress Susan Roces.
“I am only one of 24 senators. Whatever I say, even if I am for it or against it, if the majority will not side with my opinion, it will not prevail,” Poe told ANC last Wednesday.
She previously promised to wait for the House of Representatives’ transmittal of the network’s franchise renewal as the mandated by the Constitution.
Sotto had also defended Poe’s decision to push through with the hearing, saying it was within her authority as public services committee chair.
“We were elected to serve and protect the interest of our people, not the interest of a few, and we vow to always be faithful to our sworn oaths,” Sotto said on Saturday. (Vanne Elaine P. Terrazola)

“I don’t understand why they’re not acting on it quickly. They should conduct committee hearing then move on,” Benitez who is also the convenor of the Visayan Bloc pointed out.
The ABS-CBN issue is in congress and for the past couple of days the discussion has accelerated on the franchise and there are people against it while some are supporting it. The latest is Davao City Mayor Sara Duterte.
Benitez said the Visayan Bloc and every congressman is in agreement that it should be tackled by congress whether to grant the renewal of the franchise or not it should be subject to deliberation when they hear it in the house.
“How can you make a decision when you don’t hear about the alleged violation. Let’s hear them first,” Benitez further said.
Meanwhile Benitez said that the rumors about the plan of some congressmen to oust Congressman Alan Peter Cayetano as Speaker of the House is not true.
“Why create a coup when the end of his term nears unless the president will say something,” Benitez pointed out.

ABS-CBN ‘requires franchise to operate’
A legal luminary has agreed with former chief justice Reynato Puno’s position that ABS-CBN Corp. cannot operate with an expired franchise, a view that contradicts the opinion of Justice Secretary Menardo Guevarra.
Fr. Ranhilio Aquino, dean of San Beda University’s Graduate School of Law, told The Manila Times he was siding with Puno, “and I maintain that ABS-CBN may not operate anymore after expiry of its franchise.”
“The proposition of law is very simple. When the franchise expires, then it ceases the legal authority to operate,” he said.
To support his stand, Puno had cited the 2003 decision of the Supreme Court in the case of Associated Communications & Wireless Services vs National Telecommunications Commission (NTC), which he penned.
Guevarra, in a guidance letter to NTC Commissioner Gamaliel Cordoba, said since there was precedence and that ABS-CBN had a previous franchise, it could be considered a qualified applicant and could be given provisional authority to operate pending the renewal of its application.
Republic Act 7966, which granted the media giant a 25-year franchise, was enacted on March 30, 1995. It expires on May 4, 2020, following effectivity date, which is 15 days from the date of publication on April 19,1995.
Eleven bills on the network’s franchise renewal are pending at the House Committee on Legislative Franchises. Despite pressure from lawmakers and other groups, Speaker Alan Peter Cayetano said hearings could start in May or August.
In the meantime, Cayetano said Congress had directed the NTC to grant the network a provisional authority, citing precedence. He claimed that it was an “injustice” to shut the network while the franchise renewal bills were still pending.
Aquino disagreed with the move, saying it was against the Constitution.
“No, it’s not a possibility because there is a doctrine in constitutional law called the Doctrine of Undue Delegation. Congress cannot pass to any administrative agency the powers it has.
And only Congress has the power to grant a franchise. If I maintain your proposition that Congress can ask NTC to extend the life fo the franchise, that would in effect be giving NTC the powers of Congress and that is not allowed,” he said.
“That’s exactly why Congress should have acted on it, prior to its expiration,” he added.

The senator said the Supreme Court had held in various cases that “laws and rules should be interpreted and applied not in a vacuum or in isolated abstraction but in light of surrounding circumstances and attendant facts in order to afford justice to all.”
Drilon, a former Justice secretary, said to interpret the issue in a very strict legalistic manner would put at risk the jobs of the network’s 11,000 employees “and the future of their families, without giving an opportunity for a rational discussion.”
He added that there were precedents where various entities were allowed to keep operating even with expired franchises, among them network GMA 7 and telecommunications giant Smart.
“Why, all of a sudden, should we be so strict with ABS-CBN when 11,000 jobs are on the line?” he said.
“Why can we not give Congress more time to decide on this? Is anybody’s interest harmed by the continuation of the operation of ABS-CBN, while the matter is pending in Congress?” Drilon continued.
He said the opinion of the Justice Secretary, as the legal counsel of the executive department, and the NTC, as the implementing agency in charge of telecommunications, should be given due weight and consideration.

Fr. Ranhilio Aquino, dean of San Beda University’s Graduate School of Law, told The Manila Times he was siding with Puno, “and I maintain that ABS-CBN may not operate anymore after expiry of its franchise.”
“The proposition of law is very simple. When the franchise expires, then it ceases the legal authority to operate,” he said.
To support his stand, Puno had cited the 2003 decision of the Supreme Court in the case of Associated Communications & Wireless Services vs National Telecommunications Commission (NTC), which he penned.
Guevarra, in a guidance letter to NTC Commissioner Gamaliel Cordoba, said since there was precedence and that ABS-CBN had a previous franchise, it could be considered a qualified applicant and could be given provisional authority to operate pending the renewal of its application.
Republic Act 7966, which granted the media giant a 25-year franchise, was enacted on March 30, 1995. It expires on May 4, 2020, following effectivity date, which is 15 days from the date of publication on April 19,1995.
Eleven bills on the network’s franchise renewal are pending at the House Committee on Legislative Franchises. Despite pressure from lawmakers and other groups, Speaker Alan Peter Cayetano said hearings could start in May or August.
In the meantime, Cayetano said Congress had directed the NTC to grant the network a provisional authority, citing precedence. He claimed that it was an “injustice” to shut the network while the franchise renewal bills were still pending.
Aquino disagreed with the move, saying it was against the Constitution.
“No, it’s not a possibility because there is a doctrine in constitutional law called the Doctrine of Undue Delegation. Congress cannot pass to any administrative agency the powers it has.
And only Congress has the power to grant a franchise. If I maintain your proposition that Congress can ask NTC to extend the life fo the franchise, that would in effect be giving NTC the powers of Congress and that is not allowed,” he said.
“That’s exactly why Congress should have acted on it, prior to its expiration,” he added.

Abdullah Hashim, son of Moro Islamic Liberation Front (MILF) founder Hashim Salamat, was named the final member of the Bangsamoro interim government, bringing its composition to 80 as required by the Bangsamoro Organic Law.
Hashim's name appeared in a new list of presidential appointees released by Malacañang on Friday, February 28. The documents showed Hashim was officially named a member of the Bangamoro Transition Authority (BTA) last February 11, while his appointment papers were released on February 17.
Hashim completes the MILF's nominees to the BTA. Out of the total 80 target BTA members, 41 were nominated by the MILF and named by Duterte, while the government nominated the remaining 39.
His appointment likewise completes all seats in the BTA, nearly a year after it was formed following the ratification of the Bangsamoro Law.
Since the names of the first batch of BTA members were released in March 2019, two BTA members nominated by the MILF have died – MILF leader Ghazali Jaafar and lawyer Abdul Dataya. Jaafar's seat was given to his son Mudjib Abu, while Hashim is Dataya's nephew.

The Justice department said Friday there was not enough basis to allow ABS-CBN to continue operating while the bills for the renewal of its franchise were pending in Congress.
In a six-page letter to National Telecommunications Commission, Justice Secretary Menardo Guevarra said it would be better if Congress authorized the NTC to issue a provisional authority.

• A retired Supreme Court justice said Thursday that, without a franchise, ABS-CBN would have to cease operations after May 4, contrary to the informal opinion of Justice Secretary Menardo Guevarra that a provisional permit would be enough for the media giant continue operating.

• The Palace on Thursday said there was no need for ABS-CBN to coordinate with the office of President Rodrigo Duterte in relation to the P2.6 million that would be donated by the network to a charitable institution, an amount from the Chief Executive’s unaired political ads that he refused to accept.
Duterte had already given ABS-CBN a free hand to choose the recipient of the P2.6 million, Presidential Spokesman Salvador Panelo said.
“There is no need for guidance. The President gave them blanket authority. Just donate it to your favorite charitable organization,” Panelo told reporters.
• The labor group Defend Jobs Philippines said Thursday the Senate and House resolutions on ABS-CBN’s franchise extension were good, but passing a new legislative franchise law would be best for Kapamilya workers.
According to Guevarra, it would be within the bounds of the basic principle of “fairness and justice” if Congress continued with its practice and allow broadcast entities to continue with their operations even after their franchises had expired, for as long as their applications for the renewal of their franchises had been filed before Congress.
However, Guevarra clarified that the letter to the NTC was a mere “guidance” to the NTC in dealing with the matter of ABS-CBN’s franchise.
Guevarra said if Congress allowed the media network to operate after its franchise lapsed, that would not be the first time it would do so.
This practice of Congress had benefited other entities such as the Philippine Telegraph and Telephone Corp., Smart Communications Inc. and the Catholic Bishops’ Conference of the Philippines.
“This practice of Congress is not merely a matter of procedure as it significantly affects substantial rights. For such reason, it is imperative that the same treatment be extended to all entities seeking the renewal of their franchises that are about to expire. Otherwise, it run afoul of the basic principles of fairness and justice,” Guevarra said.
“It would likewise undermine the trust and the reasonable expectation of the citizens that the state shall govern impartially and will not draw distinction that are irrelevant to a legitimate objective.”
Guevarra also said there was a gap in the law. The existing laws on franchises do not provide for the status of the operations of a radio and/or television franchise when Congress has not finally acted on a pending bill for its renewal.

Guevarra made it clear, however, that while the power to grant franchises rests on Congress, the media giant was still subject to the regulation of administrative agencies such as the NTC.
Since ABS-CBN was granted a previous franchise by Congress, it could be considered a qualified applicant and could be given provisional authority to operate pending the renewal of its application, he said.
The issue of whether the network has to shut down after its franchise ends in May is being hotly debated in the Senate and House of Representatives.
It began after Solicitor General Jose Calida petitioned the Supreme Court to revoke ABS-CBN’s franchise because of violations of ownership provisos.
But Guevarra said “there is sufficient equitable basis to allow broadcast entities to continue operating while the bills for the renewal of their respective franchises remain pending with Congress.”
He added, however, that “a more stable legal environment” could be created if Congress issues a concurrent resolution authorizing the NTC to issue a provisional authority to ABS-CBN and its affiliate companies until Congress tackles the pending bills on the franchise’s renewal.
In its consolidated reply to the Supreme Court on the quo warranto petition, Calida refuted ABS-CBN’s claim that the government was muzzling press freedom by calling for the revocation of its franchise.
He also defended the petition for a gag order on ABS-CBN, saying it did not constitute “a restraint on freedom of expression.”
Calida said the network must remember that while the freedoms of the press and expression are guaranteed by the Constitution, they were not an absolute right.
“The exercise of such right is not absolute for it may be so regulated that it shall not be injurious to the equal enjoyment of others having equal rights, not injurious to the right of the community or society,” he added.
The Constitution itself “also imposes certain limits on the freedom of speech and of the press. One of such limitation is found in Article XVI of the Constitution, which prohibits foreign media ownership,” the solicitor general said.
“The revocation of respondent ABS-CBN’s franchise does not constitute a restraint on freedom of expression or of the press because the primordial effect of such revocation is the upholding of the constitutional provision and laws governing media companies like respondent ABS-CBN,” he added.
He also denied that the gag order impairs the right to information.
“The respondents’ contention is overly sweeping, if not an altogether exaggeration. The Republic’s motion for issuance of a gag order does not seek to prohibit the dissemination of information to the public. It only seeks to restrict comments and disclosures pertaining to the pending judicial proceedings to avoid prejudging the issue, influencing the court or obstructing the administration of justice,” he said.
Calida appealed to the court to begin oral arguments to tackle the merits of the case.

Sara backs ABS-CBN franchise renewal
Davao City Mayor Sara Duterte-Carpio on Thursday supported the renewal of the franchise of media giant ABS-CBN Corp., saying her father, President Rodrigo Duterte, was also concerned about the fate of its employees.
Duterte-Carpio made the statement a day after the President accepted the network’s apology over the airing of an advertisement maligning him during the 2016 presidential campaign.
“Davao City fully supports ABS-CBN sa kanilang pagpapa-renew ng kanilang franchise (in the renewal of its franchise). Of course, malaki din ang suporta ng ABS-CBN sa Davao City at sa buong bansa (ABS-CBN has fully supported Davao City and the entire nation).
Hopefully, ma-resolve in a very positive way ang issue ng franchise (the franchise issue will be resolved in a very positive way),” she said in an interview in Sulu.
“Alam niyo, si President Duterte, maawain ‘yan na tao. So, iniisip din niya ‘yung trabaho ng maraming employees [of] ABS-CBN (You know, President Duterte is a compassionate person. He is thinking of the jobs of ABS-CBN’s many employees),” the mayor added.

Duterte-Carpio made the statement a day after the President accepted the network’s apology over the airing of an advertisement maligning him during the 2016 presidential campaign.
“Davao City fully supports ABS-CBN sa kanilang pagpapa-renew ng kanilang franchise (in the renewal of its franchise). Of course, malaki din ang suporta ng ABS-CBN sa Davao City at sa buong bansa (ABS-CBN has fully supported Davao City and the entire nation).

BARMM asks DILG for Cotabato City jurisdiction handover
COTABATO CITY – The highest policy-making body of the Bangsamoro Autonomous Region in Muslim Mindanao (BARMM) has requested the Department of the Interior and Local Government to immediately turn over Cotabato City to the regional government under the supervision of the region’s Ministry of the Interior and Local Government (MILG-BARMM).
A resolution passed by the Bangsamoro Transition Authority (BTA) on February 24 pointed out that the turnover of Cotabato City is mandated under the provisions of Republic Act 11054 or the Bangsamoro Organic Law (BOL).
The resolution quoted paragraph D, Section 3 of Article XV of the BOL stating that “the city of Cotabato shall form part of the Bangsamoro Autonomous Region if the majority of the votes cast in the city shall be in favor of its inclusion.”
On Jan. 21, 2019, residents of Cotabato City affirmed its inclusion to the BARMM through a plebiscite with 36,682 “yes” votes over the 24,994 “no” votes.
Sitting as the national plebiscite board of canvassers, the Commission on Elections (Comelec) on January 25 last year certified the results of the plebiscite for the ratification and inclusion of Cotabato City in BARMM.
However, the local government headed by Mayor Cynthia Guiani-Sayadi has a pending case before the Comelec and the Supreme Court questioning the results of the plebiscite.
Last week, President Rodrigo Duterte met with Sayadi and BARMM interim chief Minister Murad Ebrahim to resolve the issue.
The President told Sayadi and Ebrahim he will decide on the matter in due time and that his decision will be for the good of both sides.
Lawyer Naguib Sinarimbo, MILG minister and concurrent BARMM spokesperson, said that since Cotabato City by virtue of the plebiscite has been constituted "as part and parcel of the BARMM, no executive action may detach it from the autonomous region."
“Under the law, the inclusion of Cotabato City is automatic and mandatory. No further action is needed and when people have spoken, it must be carried out,” Sinarimbo said in a statement.
Aside from Cotabato City, 63 villages in six towns of North Cotabato province have opted to join BARMM during the 2019 regional plebiscite. that joined the plebiscite.

It’s up to lower house to tackle ABS-CBN’s franchise renewal, says President Duterte
President Rodrigo Roa Duterte on Wednesday said he will leave ABS-CBN’s impending franchise renewal to Congress adding he has accepted the media network’s apology.
“I have kept a healthy distance from… It’s now in — that they are deliberating in Congress, the Lower House and the Senate. And there’s a plan that they would pass a joint resolution something,” President Duterte said in an interview regarding ABS-CBN’s franchise renewal.
“But fundamentally, really, ang decision nasa House ngayon. Not so much of the Senate because the Constitution says all of these things must originate from the Lower House.”
He also vowed not to interfere with the work of Congress on the issue.
At the same time, the President said he can’t do much about the quo warranto petition filed by the Office of the Solicitor General at the Supreme Court.
“Ang problema kasi nitong sa SolGen, once he makes an official statement that there is a violation of law, then stopped na ako. Parang hindi na ako makagalaw,” the President said.
“I cannot tell him to stop. The SolGen can only announce that there is a violation of law and that he is going to investigate it. Well, hindi ko masabihan, ‘Do not do it. Stop it.’”
With regards to the P2.6 million that the ABS-CBN intends to return, the President advised the network to donate the money to any charitable institution of its choice.
The President also told reporters that he has asked agriculture officials to come up with a protocol to control the spread of African Swine Fever (ASF) in the country.
The prohibition of some local government units on the passage of meat cargoes in their jurisdiction might create confusion that’s why a guideline is necessary, according to the President.
Localities that are declared free of the disease must be certified so that they can ship their meat products, he added.
“Kasi ‘yung iba ayaw pa ipadaan eh. They do not allow the cargoes of the pork meat to pass the highways that traverse the local government units, magulo ‘yan,” he said.
“So kung may tatak na, ‘yung wala at meron pa ‘yung swine fever, eh ‘di huwag na muna.”

House enjoins NTC to grant provisional authority to ABS-CBN
Folllowing the assurances made by House Speaker Alan Peter Cayetano that ABS-CBN Corporation will be able to continue their broadcast while Congress is deliberating on the renewal of its franchise, House Committee on Legislative Franchise Chair Franz Alvarez has sent a letter to the National Telecommunications Commission (NTC) Commissioner enjoining the agency to grant ABS-CBN a provisional authority to operate effective from May 4, 2020 until such time that the Congress has made a decision on its application.
The ABS-CBN franchise is set to expire on May 4, 2020, because RA 7966 stipulates that the franchise has become effective 15 days from the date of its publication, which was April 19,1995.
Cong. Alvarez and Speaker Cayetano informed the NTC that the House Committee on Legislative Franchises has started deliberating on ABS-CBN Corporation's application for the renewal of its franchise. They noted that the said Committee has instructed all interested parties to submit their position papers for or against ABS-CBN’s application within a period of sixty (60) days from Feb 24,2020.
The letter underscored that the House of Representatives has the exclusive original jurisdiction and authority to act on franchise applications.
Speaker Cayetano also reiterated his earlier stand that Congress will prioritize more urgent measures concerning the rehabilitation of Batangas, the prevention of the spread of the COVID-19 virus, the creation of the Departments of OFWs and Disaster Resilience, as well as several revenue measures being pushed by the Duterte administration that will help bring in millions of new jobs.
“As we have been saying from the start, since ABS-CBN will be allowed to continue its broadcast while we are hearing their renewal, there is no urgency that would justify a hasty proceeding. We want to be sure that this matter is given the importance it deserves,” says Cayetano.
In the same letter, the two House leaders enjoin the NTC to grant ABS-CBN Corporation’s subsidiaries and /or affiliates, whose franchise applications are pending deliberation with the House Committee on Legislative Franchises, the same provisional authority.
The said subsidiaries and/or affiliates are the following: 1) ABS-CBN Convergence, Inc., 2) Sky Cable Corporation, and 3) Amcara Broadcasting Network, Inc.
They urged NTC to include in the respective provisional authorities terms and conditions that the agency deems appropriate to protect public interest consistent with applicable laws, rules, and regulations.

Franchise resolutions not binding – Palace
Malacañang on Wednesday disputed the stand of lawmakers that ABS-CBN Corp. can continue to operate based on a provisional permit from the National Telecommunications Commission (NTC).
Palace spokesman Salvador Panelo maintained that a concurrent resolution from the Senate and the House of Representatives authorizing the NTC to extend ABS-CBN’s franchise cannot be binding as “it has to be a law.”
Panelo criticized lawmakers, particularly members of the House, for not acting on pending bills seeking to renew the franchise of ABS-CBN network.
“If they can pass a resolution, I cannot understand why they cannot pass a law on either the renewal or grant of a franchise, whether with respect to ABS-CBN or other pending applicants, because the vote needed for a resolution is a majority vote. The vote needed for passing a law is also a majority vote,” Panelo told reporters.
“A resolution cannot be binding. It has to be a law,” the Palace official added.
Panelo, who also serves as President Rodrigo Duterte’s top legal counsel, noted that former chief justice Reynato Puno has shared his opinion that “a resolution cannot be as binding and effective as law.”
“There has been a Supreme Court ruling many years ago that a resolution cannot be as binding and effective as a law so they really need to do their work. They should be accountable to the people. They are supposed to represent their districts so they will have to account to their constituents why they haven’t done anything on this particular subject matter,” he said.
Sen. Mary Grace Poe, who led a hearing on ABS-CBN’s compliance with its franchise, said that an extension of the franchise by the NTC, by authority of the concurrent resolution, was a “cure” should lawmakers lack time to tackle a franchise bill.
“This act of Congress requesting the NTC to extend the franchise is also by authority of Congress that’s why the proposal of having either a joint resolution or concurred resolution could cure it,” she added.

“We likewise enjoin you to grant ABS-CBN Corporation’s subsidiaries and / or affiliates, whose applications are pending deliberation with the Committee on Legislative Franchises, the same provisional Authoirty. The said subsidiaries and/or affiliates are the following: 1) ABS-CBN Convergence, Inc, 2) Sky Cable Corporation, and 3) Amcara Broadcasting Network, Inc.,” it added.
Also on Wednesday, Senate Minority Leader Franklin Drilon denied the insinuation of Sen. Christopher Lawrence “Bong” Go that there was politics behind his move seeking the extension of the network’s franchise.
The senator on Wednesday filed concurrent Resolution 6 expressing the sense of Congress that ABS-CBN should continue to operate pending final determination of the renewal of its franchise by the 18th Congress.
Concurrent Resolution 6 also aims to encourage the NTC to issue ABS-CBN provisional authority to operate.
Drilon noted that the 25-year franchise of ABS-CBN, granted under Republic Act 7966, would expire on May 4, 2020.
“I regret the statement of Sen. Bong Go. Being a neophyte senator, he may not be aware of our tradition and our rules,” Drilon said in a chance interview. “Precisely a concurrent resolution does not go through the President because it has no force and effect of a law,” he said.
“It is just a sense of the Senate. There is no politics here. We are not depriving the President of the right to veto or approve,” he added. “The right to veto or approve is in the joint resolution (SJR 11) that we filed, which has the force and effect of a law and which is also filed in the House of Representatives (HoR),” he said.
Cagayan de Oro City Rep. Rufus Rodriguez, an author of one of the 11 bills, filed House Joint Resolution (HJR) 29 on Wednesday that seeks to extend the network’s franchise for one year or until May 4, 2021.
This was separate from HJR 28 filed by Rep. Raul Del Mar last week, which seeks to extend the network’s franchise up to June 30, 2022 or the end of the 18th Congress.
Albay Rep. Edcel Lagman, however, agreed with Puno’s position that ABS-CBN cannot operate without a renewed franchise.

This was separate from HJR 28 filed by Rep. Raul Del Mar last week, which seeks to extend the network’s franchise up to June 30, 2022 or the end of the 18th Congress.
Albay Rep. Edcel Lagman, however, agreed with Puno’s position that ABS-CBN cannot operate without a renewed franchise.

Lawmaker files resolution seeking to extend ABS-CBN franchise until May 2021
A lawmaker has filed a resolution that extends the expiring ABS-CBN franchise by a year, after the Senate hearing on the broadcast giant stated that the quo warranto filed against it by Solicitor General Jose Calida had no basis.
Under House Joint Resolution 29, ABS-CBN's franchise will extend until May 4, 2021, as it will expire on May 4 of this year.
Cagayan de Oro Rep. Rufus Rodriguez said Wednesday it covers only a year-long extension since he doesn't want Congress to "dilly-dally" on the franchise renewal of ABS-CBN.
“Let us have this maximum. We'll have 1 year so we can also have some urgency on this," Rodriguez told reporters.
The resolution cites, among others, that ABS-CBN passed the scrutiny of all state regulators, namely the Department of Justice (DOJ), the Bureau of Internal Revenue (BIR), the Department of Labor and Employment (DOLE), and the Securities and Exchange Commission (SEC).
“That Senate hearing, it was very good because you know it clearly showed Calida’s quo warranto had no basis in law," Rodriguez said.
Calida’s petition alleged, among others, that ABS-CBN violated the constitutional ban on foreign ownership in mass media by issuing Philippine Depository Receipts to foreigners, through its holding company.
Company executives, in response, told senators that the issuance of the financial instruments complied with the law.
Rodriguez said ABS-CBN’s franchise must also be extended because of the rule of equity, or substantial justice.
”By reason of the law of equity, it can go on, and past experiences also show that other franchises are allowed to go on because of equity," the lawmaker said.
Earlier, Justice Secretary Menardo Guevarra said ABS-CBN can still operate under "equity considerations" should its bid for a fresh 25-year franchise fail in Congress.
"May gap 'yong batas. Kaya we draw from equity considerations para fair. Para may substantial justice. Para walang agrabyado. As I've said, hindi naman kasalanan no'ng company na hindi pa naaaprubahan ng Kongreso 'yong kaniyang application," he said.

“The rule of equity does not apply when the law is clear. In the case of the ABS-CBN franchise, the law is clear. The law says that no one can engage in telecommunication enterprise without first acquiring a franchise and the act granting franchise ABS-CBN says it is good only up to 25 years from its effectivity,” Lagman said.
“When the law is clear, they apply the law.”
